सर्वोच्च न्यायालय
इस अध्याय में जहाँ भी वर्तमान/संवैधानिक तथ्य समय के साथ बदल सकते हैं, उन्हें आधिकारिक न्यायपालिका स्रोतों से cross-check किया गया है। सर्वोच्च न्यायालय स्वयं अपनी jurisdiction में Original, Appellate और Advisory jurisdiction तथा Article 32 के अंतर्गत Fundamental Rights enforcement की शक्ति को स्पष्ट करता है।
1. भारत का सर्वोच्च न्यायालय
भारत में Supreme Court of India देश का सर्वोच्च न्यायिक निकाय (Highest Judicial Court) है।
यह:
- संविधान का संरक्षक (Guardian of the Constitution)
- मौलिक अधिकारों का संरक्षक
- न्यायिक पुनरावलोकन (Judicial Review) का प्रमुख संस्थान
- संघीय विवादों का निर्णायक
- अंतिम अपीलीय न्यायालय
2. संविधान का कौन-सा भाग?
सर्वोच्च न्यायालय का प्रावधान भाग V — संघ (The Union) के अध्याय IV — संघ की न्यायपालिका में है।

4. सर्वोच्च न्यायालय की स्थापना
भारत का Supreme Court 28 जनवरी 1950 को अस्तित्व में आया।
यह Federal Court of India का उत्तराधिकारी बना।
5. Federal Court
भारत में Federal Court 1937 में Government of India Act, 1935 के अंतर्गत स्थापित हुआ था।
संविधान लागू होने के बाद: Federal Court → Supreme Court में परिवर्तित हुआ।
6. Supreme Court का उद्घाटन
28 जनवरी 1950 को भारत के Supreme Court ने कार्य प्रारंभ किया।
प्रारंभिक रूप से यह Parliament House परिसर में कार्य करता था।
बाद में वर्तमान Tilak Marg परिसर में स्थानांतरित हुआ।
7. Supreme Court की संरचना
संविधान के मूल अनुच्छेद 124 में Chief Justice of India + अन्य Judges की व्यवस्था है।
न्यायाधीशों की संख्या संसद कानून द्वारा निर्धारित कर सकती है।
8. वर्तमान अधिकतम स्वीकृत संख्या
वर्तमान व्यवस्था के अनुसार Supreme Court में 34 Judges तक हो सकते हैं: Chief Justice of India + 33 other Judges

9. Supreme Court Judge की नियुक्ति — Article 124
न्यायाधीशों की नियुक्ति राष्ट्रपति करता है।
लेकिन आज की संवैधानिक practice में यह नियुक्ति Collegium system की recommendation के आधार पर होती है।
10. Collegium क्या है?
Collegium संविधान में सीधे लिखित संस्था नहीं है।
यह Supreme Court के judgments से विकसित judicial appointments mechanism है।
11. Supreme Court Collegium
Supreme Court के Judges की नियुक्ति के लिए Collegium में CJI + 4 वरिष्ठतम Supreme Court Judges होते हैं।
अर्थात: कुल 5
Supreme Court Collegium = CJI + 4 senior-most Judges
Supreme Court की वर्तमान Collegium resolutions में Supreme Court judge appointments की recommendations सार्वजनिक की जाती हैं; न्यायालय ने appointment process को भी अपनी वेबसाइट पर उपलब्ध कराया है।
12. High Court Collegium
High Court के Chief Justice/Judges के लिए संबंधित High Court Collegium सामान्यतः Chief Justice + 2 senior-most Judges से बना होता है।
लेकिन final recommendation की प्रक्रिया Supreme Court Collegium तक जाती है।
13. Collegium System कैसे आया?
इसके लिए तीन महत्वपूर्ण Supreme Court cases याद करें:
- First Judges Case — 1981 — S.P. Gupta v. Union of India
- Second Judges Case — 1993 — Supreme Court Advocates-on-Record Association v. Union of India
- Third Judges Case — 1998 — Special Reference No. 1 of 1998
14. First Judges Case — 1981
Supreme Court ने Executive की भूमिका को अधिक महत्व दिया।
CJI की opinion को निर्णायक primacy नहीं दी गई।
15. Second Judges Case — 1993
यह बहुत महत्वपूर्ण turning point है।
Supreme Court ने Judicial Primacy को स्थापित किया।
यहीं से Collegium System का आधुनिक स्वरूप विकसित हुआ।
16. Third Judges Case — 1998
राष्ट्रपति ने Supreme Court से clarification मांगा।
Supreme Court ने Collegium का विस्तार किया।
Supreme Court appointments — CJI + 4 senior-most Judges
17. NJAC क्या था?
2014 में संसद ने 99वाँ संविधान संशोधन और National Judicial Appointments Commission Act पारित किया।
उद्देश्य: Collegium के स्थान पर NJAC व्यवस्था लाना।
18. NJAC में क्या हुआ?
2015 में Supreme Court ने 99th Constitutional Amendment और NJAC Act को असंवैधानिक घोषित कर दिया।
परिणाम: Collegium System जारी रहा।

19. Judge बनने की योग्यता — Article 124(3)
Supreme Court Judge बनने के लिए व्यक्ति:
विकल्प 1 — कम-से-कम 5 वर्ष तक High Court का Judge रहा हो।
या:
विकल्प 2 — कम-से-कम 10 वर्ष तक High Court का Advocate रहा हो।
या:
विकल्प 3 — राष्ट्रपति की राय में Distinguished Jurist हो।
20. Distinguished Jurist
संविधान Supreme Court Judge के लिए Distinguished Jurist को भी eligible category मानता है।
लेकिन व्यवहार में अब तक इस category के तहत Supreme Court Judge नियुक्त नहीं हुआ है।
Distinguished Jurist नियुक्ति का प्रावधान नहीं है।

Judge अपना इस्तीफा राष्ट्रपति को देता है।

25. Removal का आधार
केवल:
- Proved Misbehaviour

26. संसद में Removal Process
प्रस्ताव लोकसभा या राज्यसभा किसी भी सदन में शुरू हो सकता है।
लेकिन: दोनों सदनों से पारित होना आवश्यक है।
27. Special Majority
प्रत्येक सदन में:
- कुल सदस्य संख्या का बहुमत
- और उपस्थित एवं मतदान करने वाले सदस्यों के 2/3 बहुमत

मुख्यतः संघ और राज्यों के बीच कुछ प्रकार के legal-right disputes Supreme Court के Original Jurisdiction में आते हैं।

Supreme Court स्वयं भी Article 131 को exclusive original jurisdiction के रूप में वर्णित करता है।

36. Habeas Corpus
अर्थ: "Produce the body"
उद्देश्य: अवैध हिरासत से व्यक्ति को मुक्त कराना।
37. Mandamus
अर्थ: We Command
यह किसी public authority को उसका कानूनी कर्तव्य पूरा करने का आदेश दे सकता है।
38. Prohibition
यह Lower Court/Tribunal को उसकी jurisdiction से बाहर जाने से रोकता है।
Nature: Preventive
39. Certiorari
यह Lower Court/Tribunal के आदेश को quash कर सकता है।
Nature: Corrective

यह पूछता है: व्यक्ति किसी public office पर किस अधिकार से बैठा है?

Supreme Court — Article 32: केवल Fundamental Rights enforcement के लिए।
High Court — Article 226: Fundamental Rights + Other Legal Rights दोनों के लिए writ जारी कर सकता है।
HC writ jurisdiction is wider than SC writ jurisdiction under Article 32.
43. Appellate Jurisdiction
Supreme Court High Courts और अन्य न्यायिक निकायों से आने वाली appeals सुन सकता है।
44. Article 136 — Special Leave Petition (SLP)
Supreme Court को किसी Court/Tribunal के judgment, decree, determination, sentence या order के विरुद्ध विशेष अनुमति से appeal सुनने की व्यापक discretionary power देता है।
Supreme Court अपनी official jurisdiction page पर Article 136 को अत्यंत व्यापक appellate jurisdiction के रूप में वर्णित करता है।
45. क्या Article 136 Fundamental Right है?

46. Advisory Jurisdiction — Article 143
राष्ट्रपति किसी महत्वपूर्ण question of law या fact पर Supreme Court से opinion मांग सकता है।

Supreme Court द्वारा घोषित Law भारत के सभी courts पर Binding होता है।

न्यायपालिका की स्वतंत्रता के लिए:

- कठिन removal procedure;
- वेतन/भत्तों की संवैधानिक सुरक्षा;

The Supreme Court came into existence on 28 January 1950.
It succeeded the Federal Court of India.

The Federal Court was established in 1937 under the Government of India Act, 1935.
