1. उच्च न्यायालय क्या है?

उच्च न्यायालय राज्य की सर्वोच्च न्यायिक संस्था (Highest Judicial Court at State level) है।

भारत में High Court:

4. Article 214

संविधान कहता है: प्रत्येक राज्य के लिए एक High Court होगा।

लेकिन इसका अर्थ यह नहीं कि हर राज्य का अलग-अलग High Court होना अनिवार्य ही है।

क्योंकि: Article 231 के तहत दो या अधिक राज्यों के लिए Common High Court बनाया जा सकता है।


5. भारत में वर्तमान High Courts

भारत में वर्तमान में 25 High Courts हैं।

इनमें कुछ एक से अधिक राज्यों/केंद्रशासित प्रदेशों के लिए भी jurisdiction रखते हैं।


6. Common High Court

एक High Court एक से अधिक राज्यों या राज्य + केंद्रशासित प्रदेश के लिए हो सकता है।

उदाहरण — Punjab & Haryana High Court: इसका jurisdiction Punjab, Haryana, Chandigarh तक है।


7. एक और महत्वपूर्ण उदाहरण

Bombay High Court: इसका jurisdiction Maharashtra, Goa और कुछ Union Territories तक है।

यह भारत के सबसे पुराने High Courts में से एक है।

इसी क्रम में Rajasthan High Court का गठन हुआ।

High Court के Chief Justice की नियुक्ति राष्ट्रपति करता है।

लेकिन प्रक्रिया में CJI, संबंधित राज्य के Governor, Collegium की संवैधानिक/न्यायिक भूमिका होती है।


21. High Court Judge की नियुक्ति — Article 217

High Court Judge की नियुक्ति राष्ट्रपति करता है।


22. Consultation

High Court Judge की नियुक्ति में राष्ट्रपति Chief Justice of India और संबंधित राज्य के Governor से consultation करता है।

Chief Justice के अतिरिक्त अन्य Judge के मामले में संबंधित High Court के Chief Justice से भी consultation होता है।

व्यवहार में High Court appointments में High Court Collegium और Supreme Court Collegium महत्वपूर्ण भूमिका निभाते हैं।


24. High Court Collegium

आमतौर पर Chief Justice + 2 senior-most Judges से बना होता है।

यह recommendation Supreme Court Collegium तक जाती है।

अंततः राष्ट्रपति High Court Judge को नियुक्त करता है।

Article 220 के अनुसार permanent High Court Judge retirement के बाद Supreme Court और अन्य High Courts के सामने practice कर सकता है, लेकिन उस High Court और उसके अधीनस्थ courts के सामने नहीं।

A High Court is the Highest Judicial Court at State level.

In India, a High Court:

4. Article 214

The Constitution says: There shall be a High Court for each State.

But this does not mean that every State must have a separate High Court.

Because under Article 231, a Common High Court can be established for two or more States.

  1. Is a citizen of India; and
  2. Has held a judicial office in India for at least 10 years; OR
  3. Has been an Advocate of a High Court for at least 10 years.

16. Resignation and Removal

A High Court Judge submits resignation to the President.

Removal is by the President through the same parliamentary special-majority procedure as for Supreme Court Judges, on grounds of Proved Misbehaviour or Incapacity.

Governor cannot appoint or remove High Court Judges.

29. Chapter Summary

The High Court is the highest judicial body at the state level, established under Articles 214 to 231.
