अध्याय 15 — मानवाधिकार संस्थाएँ
अब हम आपके मूल syllabus के अध्याय 15 पर हैं। इस अध्याय को केवल NHRC की सामान्य जानकारी तक सीमित नहीं रखेंगे; कानून, संरचना, नियुक्ति, कार्यकाल, हटाने की प्रक्रिया, शक्तियाँ, सीमाएँ, SHRC, Human Rights Courts, राजस्थान और वर्तमान 2026 पदाधिकारी तक पूरा करेंगे।
1. मानवाधिकार क्या हैं?
मानवाधिकार (Human Rights) वे अधिकार हैं जो:
- प्रत्येक व्यक्ति को केवल मानव होने के कारण प्राप्त होते हैं।
इनका संबंध मुख्यतः:
- जीवन
- स्वतंत्रता
- समानता
- गरिमा
- सुरक्षा
- शोषण से मुक्ति
से है।
भारत में मानवाधिकार संरक्षण का संवैधानिक आधार मुख्यतः:
- मौलिक अधिकार + राज्य के नीति-निर्देशक तत्व + न्यायिक व्याख्या
और संस्थागत आधार:
- Protection of Human Rights Act, 1993
है।
2. मानवाधिकार संरक्षण अधिनियम, 1993
Protection of Human Rights Act, 1993
इस अधिनियम द्वारा:
- राष्ट्रीय मानवाधिकार आयोग — NHRC
- राज्य मानवाधिकार आयोग — SHRC
- मानवाधिकार न्यायालय — Human Rights Courts
की व्यवस्था की गई।
NHRC = Statutory Body
❌ संवैधानिक निकाय नहीं।
3. NHRC की स्थापना
National Human Rights Commission — NHRC
भारत में NHRC की स्थापना:
- 12 अक्टूबर 1993
को हुई।
कानूनी आधार:
- Protection of Human Rights Act, 1993
4. NHRC का मुख्य उद्देश्य
NHRC का उद्देश्य:
- मानवाधिकारों का संरक्षण एवं संवर्धन (Protection and Promotion of Human Rights)
करना है।
मानवाधिकारों में विशेष रूप से:
- जीवन, स्वतंत्रता, समानता और व्यक्ति की गरिमा
से जुड़े अधिकार शामिल हैं।

6. NHRC की वर्तमान संरचना — 2026
Protection of Human Rights Act की धारा 3 के अनुसार आयोग की संरचना में Chairperson और निर्धारित Members होते हैं। वर्तमान NHRC composition page के अनुसार:

Members
- Justice Bidyut Ranjan Sarangi
- Smt. Vijaya Bharathi Sayani
- Shri Priyank Kanoongo
NHRC की आधिकारिक वेबसाइट के अनुसार Justice V. Ramasubramanian ने 30 दिसंबर 2024 को Chairperson का पद संभाला।
7. महिला सदस्य
वर्तमान NHRC में:
- Smt. Vijaya Bharathi Sayani
सदस्य हैं।
यह भी महत्वपूर्ण है कि अधिनियम में मानवाधिकार संबंधी विशेषज्ञ सदस्यों में:
- कम-से-कम एक महिला
होना आवश्यक है।
8. NHRC की संरचना — परीक्षा के लिए
वर्तमान वैधानिक व्यवस्था के अनुसार:
Chairperson
- ऐसा व्यक्ति जो:
- भारत के Chief Justice of India (CJI) या Supreme Court के Judge
रहे हों।
एक Member
- Supreme Court के Judge रहे हों।
एक Member
- किसी High Court के Chief Justice रहे हों।
तीन Members
- मानवाधिकार मामलों में:
- ज्ञान या व्यावहारिक अनुभव
रखने वाले व्यक्तियों में से।
इन तीन में:
- कम-से-कम एक महिला
होना आवश्यक है।
9. Deemed Members — बहुत महत्वपूर्ण
NHRC में कुछ अन्य राष्ट्रीय आयोगों के प्रमुख:
- Deemed Members
के रूप में शामिल होते हैं।
वर्तमान NHRC के अनुसार इनमें:
- National Commission for Backward Classes
- National Commission for Minorities
- National Commission for Protection of Child Rights
- National Commission for Scheduled Castes
- National Commission for Scheduled Tribes
- National Commission for Women
- Chief Commissioner for Persons with Disabilities
के प्रमुख शामिल हैं।
ये सभी NHRC के पूर्णकालिक Members हैं।
ये: Deemed Members हैं और अधिनियम में निर्दिष्ट कार्यों के निर्वहन के लिए आयोग से जुड़े हैं।
10. Secretary-General
NHRC में:
- Secretary-General
आयोग का:
- Chief Executive Officer
होता है।
वर्तमान में:
- Shri Piyush Goyal
Secretary-General एवं CEO हैं; उन्होंने 24 जुलाई 2026 को पद ग्रहण किया।
11. NHRC का नियुक्ति तंत्र
NHRC के Chairperson और Members की नियुक्ति:
- राष्ट्रपति (President of India)
द्वारा की जाती है।
लेकिन राष्ट्रपति सीधे अपनी पसंद से नियुक्ति नहीं करता।
इसके लिए:
- Selection Committee
की व्यवस्था है।
12. Selection Committee
समिति में प्रमुख रूप से:
- प्रधानमंत्री — अध्यक्ष
- लोकसभा अध्यक्ष
- गृह मंत्री
- लोकसभा में विपक्ष के नेता
- राज्यसभा में विपक्ष के नेता
- राज्यसभा के उपसभापति
शामिल होते हैं।
NHRC Chairperson की नियुक्ति प्रधानमंत्री करता है।

13. NHRC Chairperson का कार्यकाल
वर्तमान कानून के अनुसार:
- 3 वर्ष
या:
- 70 वर्ष की आयु
तक,
जो पहले हो।
2019 के संशोधन के बाद पहले की 5 वर्ष वाली व्यवस्था बदलकर 3 वर्ष की गई तथा पुनर्नियुक्ति की पात्रता जोड़ी गई।
NHRC → 3 वर्ष / 70 वर्ष
14. क्या Chairperson पुनर्नियुक्त हो सकता है?
हाँ।
वर्तमान कानून के अनुसार:
- Chairperson re-appointment के लिए eligible है।
लेकिन:
- 70 वर्ष की आयु
के बाद पद पर नहीं रह सकता।
15. Member का कार्यकाल
Member भी:
- 3 वर्ष
के लिए नियुक्त होता है।
और:
- 70 वर्ष
की आयु के बाद पद पर नहीं रह सकता।
16. पद छोड़ने के बाद सरकारी रोजगार
NHRC Chairperson/Member:
- पद छोड़ने के बाद भारत सरकार या किसी राज्य सरकार के अधीन आगे रोजगार के लिए पात्र नहीं होता।
यह प्रावधान आयोग की स्वतंत्रता से संबंधित महत्वपूर्ण सुरक्षा है।
17. Chairperson की मृत्यु/इस्तीफा/रिक्ति
यदि Chairperson का पद:
- मृत्यु
- इस्तीफा
- अन्य कारण
से रिक्त हो जाए,
तो:
- राष्ट्रपति किसी Member को Acting Chairperson के रूप में अधिकृत कर सकता है।
इसी प्रकार Chairperson की अनुपस्थिति/अवकाश में भी राष्ट्रपति किसी Member को उनके कार्य करने के लिए अधिकृत कर सकता है।
Acting Chairperson को NHRC Member स्वयं चुनते हैं।
President authorises.
18. NHRC को हटाने की शक्ति
Chairperson/Member को:
- राष्ट्रपति
हटा सकता है।
लेकिन:
- Misbehaviour या incapacity
जैसे आधारों पर हटाने के लिए:
- Supreme Court inquiry
की संवैधानिक/वैधानिक प्रक्रिया लागू होती है।
NHRC Chairperson को प्रधानमंत्री हटा सकता है।
President removes, but only after Supreme Court inquiry in cases of misbehaviour/incapacity.
19. NHRC के प्रमुख कार्य
अब सबसे महत्वपूर्ण हिस्सा।
Section 12
NHRC:
1. Human Rights Violation की जाँच
- मानवाधिकार उल्लंघन की शिकायतों की:
- जाँच (Inquiry)
कर सकता है।
2. Suo Motu
- यदि आयोग को:
- मीडिया रिपोर्ट, सूचना या अन्य माध्यम से
मानवाधिकार उल्लंघन की जानकारी मिलती है,
तो वह:
- Suo Motu
कार्यवाही शुरू कर सकता है।
NHRC → Suo Motu power
3. Court Proceedings में Intervention
- मानवाधिकार उल्लंघन से संबंधित:
- न्यायिक कार्यवाही
में आयोग:
- न्यायालय की अनुमति से
हस्तक्षेप कर सकता है।
4. Jail/Detention Institutions का निरीक्षण
- NHRC:
- जेल, detention centres और अन्य संस्थानों
का निरीक्षण कर सकता है।
उद्देश्य:
- कैदियों/नजरबंद व्यक्तियों के मानवाधिकारों की स्थिति का अध्ययन।
5. Safeguards की समीक्षा
- संविधान और कानून द्वारा दिए गए:
- Human Rights Safeguards
की समीक्षा करता है।
6. आतंकवाद के मानवाधिकार प्रभाव
- आयोग:
- Terrorism के मानवाधिकारों पर प्रभाव
से संबंधित परिस्थितियों की समीक्षा कर सकता है।
7. International Instruments
- मानवाधिकारों से संबंधित:
- International Treaties और Instruments
का अध्ययन करके उनके प्रभावी कार्यान्वयन के लिए सुझाव दे सकता है।
8. Research
- मानवाधिकार विषयों पर:
- Research
कर सकता है।
9. Human Rights Awareness
- मानवाधिकारों के संबंध में:
- जन-जागरूकता
बढ़ाने का कार्य करता है।
10. NGOs को प्रोत्साहन
- मानवाधिकार क्षेत्र में कार्य करने वाले:
- NGOs और Institutions
के प्रयासों को प्रोत्साहित करता है।
20. NHRC की जाँच शक्तियाँ
NHRC को जाँच के दौरान:
- Civil Court जैसी कुछ शक्तियाँ
प्राप्त हैं।
उदाहरण:
- गवाह को बुलाना
- शपथ पर परीक्षा
- दस्तावेज मंगाना
- शपथपत्र पर साक्ष्य
- सार्वजनिक रिकॉर्ड मंगाना
- आयोग/अधिकारी के माध्यम से जाँच
आदि।
21. NHRC क्या कर सकता है?
जाँच के बाद आयोग:
- सरकार/प्राधिकरण को अपनी recommendations
दे सकता है।
उदाहरण:
- पीड़ित को compensation
- prosecution
- disciplinary action
- अन्य remedial measures
की सिफारिश।
22. सबसे महत्वपूर्ण सीमा
NHRC की recommendation:
- सामान्यतः binding नहीं होती।
यानी:
- NHRC स्वयं किसी अधिकारी को दंडित नहीं करता।
वह:
- सरकार/संबंधित प्राधिकरण को recommendation
देता है।
NHRC एक मानवाधिकार न्यायालय है। ❌
23. NHRC की एक महत्वपूर्ण limitation
मानवाधिकार संरक्षण अधिनियम के तहत:
- जिस मामले में संबंधित State Commission या अन्य वैधानिक आयोग के समक्ष मामला लंबित है, NHRC सामान्यतः उस मामले की समानांतर जाँच नहीं करता।
इसी तरह:
- एक वर्ष से अधिक पुरानी घटना
पर NHRC की jurisdiction पर महत्वपूर्ण वैधानिक सीमा है।
NHRC → generally 1 year limitation
24. Armed Forces के मामले
यह बहुत महत्वपूर्ण RAS प्रश्न है।
सशस्त्र बलों से संबंधित मानवाधिकार शिकायतों में NHRC की शक्ति:
- विशेष रूप से सीमित
है।
NHRC:
- Central Government से report मांग सकता है
और:
- अपनी recommendations दे सकता है।
लेकिन सामान्य मामलों की तरह सीधे investigation powers का प्रयोग नहीं करता।
25. NHRC और Armed Forces
NHRC armed forces के प्रत्येक मामले में सीधे police investigation कर सकता है।
Armed Forces संबंधी मामलों में special procedure है।

राज्य स्तर पर मानवाधिकारों की सुरक्षा के लिए:

Rajasthan State Human Rights Commission — RSHRC
राजस्थान में राज्य मानवाधिकार आयोग:
- मानवाधिकार उल्लंघन से संबंधित शिकायतों और मामलों
पर कार्य करता है।

29. SHRC का Chairperson कौन हो सकता है?
State Human Rights Commission के Chairperson के लिए:
- High Court के Chief Justice या High Court के Judge
रहे व्यक्ति की पात्रता होती है, वैधानिक संशोधनों के अनुसार।
30. SHRC की नियुक्ति
State Human Rights Commission के Chairperson/Members की नियुक्ति:
- Governor
द्वारा की जाती है।
लेकिन:
- Selection Committee की recommendation
के आधार पर।

मुख्य रूप से:
- मुख्यमंत्री
की अध्यक्षता में चयन समिति होती है।
इसमें:

जैसे पद शामिल होते हैं।
SHRC Chairperson को मुख्यमंत्री सीधे नियुक्त करता है।

32. SHRC का कार्यक्षेत्र
State Human Rights Commission:
- राज्य सूची (State subjects) से जुड़े मामलों
में विशेष रूप से महत्वपूर्ण है।
लेकिन:
- Union List से संबंधित मामलों
में उसकी jurisdiction सीमित है।

Now we are on Chapter 15 of your original syllabus. We will not limit this chapter to just general information about NHRC; we will cover law, structure, appointment, tenure, removal process, powers, limitations, SHRC, Human Rights Courts, Rajasthan, and current 2026 office holders in full.
1. What are Human Rights?
Human Rights are rights that:
- Are available to every person merely by virtue of being human.
They primarily relate to:
- Life
- Liberty
- Equality
- Dignity
- Security
- Freedom from exploitation
In India, the constitutional basis for human rights protection is primarily:
- Fundamental Rights + Directive Principles of State Policy + Judicial Interpretation
And the institutional basis is:
- Protection of Human Rights Act, 1993

This Act provides for:
- National Human Rights Commission — NHRC
- State Human Rights Commission — SHRC
- Human Rights Courts
NHRC = Statutory Body
❌ Not a Constitutional Body.
3. Establishment of NHRC
National Human Rights Commission — NHRC
NHRC was established in India on:
- 12 October 1993

In the current NHRC:

is a member.
It is also important that among the human rights expert members under the Act:
- At least one woman
is required.
8. Structure of NHRC — For Examination
According to the current statutory framework:
Chairperson
- A person who has been:
- Chief Justice of India (CJI) or a Judge of the Supreme Court
One Member
- Who has been a Judge of the Supreme Court
One Member
- Who has been a Chief Justice of a High Court
Three Members
- From among persons having:
- Knowledge or practical experience
in human rights matters.
Among these three:
- At least one woman
is required.
9. Deemed Members — Very Important
The heads of certain other national commissions are included in NHRC as:
- Deemed Members
According to the current NHRC, these include:
- National Commission for Backward Classes
- National Commission for Minorities
- National Commission for Protection of Child Rights
- National Commission for Scheduled Castes
- National Commission for Scheduled Tribes
- National Commission for Women
- Chief Commissioner for Persons with Disabilities
All these are full-time Members of NHRC.
They are: Deemed Members and are associated with the Commission for discharging functions specified in the Act.
10. Secretary-General
In NHRC:
- Secretary-General
is the:
- Chief Executive Officer
of the Commission.
Currently:
- Shri Piyush Goyal
is the Secretary-General and CEO; he assumed office on 24 July 2026.
11. Appointment Mechanism of NHRC
The Chairperson and Members of NHRC are appointed by:
- The President of India
But the President does not appoint directly on his own choice.
For this:
- Selection Committee
is constituted.

The committee primarily consists of:
- Prime Minister — Chairperson
- Speaker of Lok Sabha
- Home Minister
- Leader of Opposition in Lok Sabha
- Leader of Opposition in Rajya Sabha
- Deputy Chairman of Rajya Sabha
Prime Minister appoints the NHRC Chairperson.

13. Tenure of NHRC Chairperson
According to current law:
- 3 years
or:
- Age of 70 years
whichever is earlier.
After the 2019 amendment, the earlier 5-year provision was changed to 3 years and re-appointment eligibility was added.

14. Can the Chairperson be re-appointed?
Yes.
According to current law:
- Chairperson is eligible for re-appointment.
But:
- Cannot remain in office after the age of 70 years.
15. Tenure of Member
A Member is also appointed for:
- 3 years
and cannot remain in office after:
- 70 years
of age.
16. Government Employment After Leaving Office
NHRC Chairperson/Member:
- Is not eligible for further employment under the Government of India or any State Government after leaving office.
This provision is an important safeguard related to the independence of the Commission.
17. Death/Resignation/Vacancy of Chairperson
If the office of Chairperson becomes vacant due to:
- Death
- Resignation
- Other reasons
then:
- The President may authorize any Member to act as Acting Chairperson.
Similarly, in the absence/leave of the Chairperson, the President may authorize any Member to perform their functions.
NHRC Members themselves choose the Acting Chairperson.
President authorises.
18. Power to Remove from NHRC
The Chairperson/Member can be removed by:
- The President
But:
- Misbehaviour or incapacity
as grounds for removal require:
- Supreme Court inquiry
as per constitutional/statutory procedure.
Prime Minister can remove the NHRC Chairperson.
President removes, but only after Supreme Court inquiry in cases of misbehaviour/incapacity.
19. Key Functions of NHRC
Now the most important part.

NHRC:
1. Inquiry into Human Rights Violations
- Can conduct:
- Inquiry
into complaints of human rights violations.
2. Suo Motu
- If the Commission receives information about human rights violations through:
- Media reports, information or other means
then it can initiate:
- Suo Motu
proceedings.

3. Intervention in Court Proceedings
- In judicial proceedings related to human rights violations:
- The Commission may intervene with:
- Court's permission
4. Inspection of Jail/Detention Institutions
- NHRC can inspect:
- Jails, detention centres and other institutions
Purpose:
- To study the human rights situation of prisoners/detainees.
5. Review of Safeguards
- Reviews:
- Human Rights Safeguards
provided by the Constitution and laws.
6. Impact of Terrorism on Human Rights
- The Commission can review circumstances related to:

20. Inquiry Powers of NHRC
During inquiry, NHRC has:
- Some powers of a Civil Court
Examples:

- Examination on oath
- Calling for documents
- Evidence on affidavits
- Calling for public records
- Inquiry through Commission/offficer
etc.
21. What Can NHRC Do?
After inquiry, the Commission can:
- Give its recommendations to the Government/Authority
Examples:
- Recommend compensation to the victim
- prosecution
- disciplinary action
- Other remedial measures
22. The Most Important Limitation
NHRC's recommendation:
- Generally not binding
That is:
- NHRC does not punish any officer itself.
It:
- Gives recommendations to the Government/concerned Authority
NHRC is a human rights court. ❌
23. An Important Limitation of NHRC
Under the Protection of Human Rights Act:
- NHRC generally does not conduct parallel inquiry in cases pending before the concerned State Commission or other statutory commissions.
Similarly:
- There is a significant statutory limitation on NHRC's jurisdiction over incidents older than one year.

24. Matters of Armed Forces
This is a very important RAS question.
NHRC's power in human rights complaints relating to Armed Forces is:
- Specifically limited
NHRC:
- Can seek report from the Central Government
and:
- Can give its recommendations.
But does not exercise direct investigation powers like in ordinary cases.

NHRC can directly conduct police investigation in every case involving Armed Forces.
