संविधान का निर्माण एवं संवैधानिक विकास
1. अध्याय का उद्देश्य
भारतीय संविधान अचानक 26 जनवरी 1950 को अस्तित्व में नहीं आया। इसके पीछे लगभग दो शताब्दियों का संवैधानिक विकास, औपनिवेशिक शासन के अनुभव, भारतीय राष्ट्रीय आंदोलन की राजनीतिक मांगें, संवैधानिक सुधारों के प्रयास, स्वतंत्रता आंदोलन के विचार तथा अंततः संविधान सभा की विस्तृत deliberative प्रक्रिया थी।
इसलिए भारतीय संविधान को समझने के लिए दो समानांतर प्रक्रियाओं को समझना आवश्यक है—
औपनिवेशिक संवैधानिक विकास
1773 → 1784 → 1813 → 1833 → 1853 → 1858 → 1861 → 1892 → 1909 → 1919 → 1935 → 1947
और
भारतीय संविधान-निर्माण की प्रक्रिया

3. भारतीय संविधान के निर्माण की ऐतिहासिक पृष्ठभूमि
भारतीय संविधान की जड़ें केवल 1946 की संविधान सभा में नहीं थीं। ब्रिटिश शासन के दौरान बनाए गए विभिन्न constitutional enactments ने प्रशासनिक संस्थाओं, विधायिकाओं, केन्द्र-प्रान्त संबंधों, प्रतिनिधित्व और निर्वाचन व्यवस्था के विकास को प्रभावित किया।
लेकिन एक महत्वपूर्ण distinction समझना चाहिए:
औपनिवेशिक Acts भारतीय संविधान के निर्माण की ऐतिहासिक पृष्ठभूमि थे; वे स्वयं भारतीय संविधान नहीं थे।
भारतीय संविधान की अंतिम वैधता संविधान सभा की constitution-making process तथा स्वतंत्र भारत की संवैधानिक व्यवस्था से आती है।
4. संवैधानिक विकास की प्रमुख अवस्थाएँ
4.1 Regulating Act, 1773
यह ब्रिटिश संसद द्वारा East India Company के शासन को regulate करने की दिशा में एक महत्वपूर्ण कदम था।
प्रमुख विशेषताएँ
- बंगाल के Governor को Governor-General of Bengal बनाया गया।
- Governor-General की सहायता के लिए चार सदस्यीय Council का प्रावधान किया गया।
- Bombay और Madras Presidencies को कुछ मामलों में Bengal के अधीन किया गया।
- Calcutta में Supreme Court की स्थापना का प्रावधान किया गया।
- Company के अधिकारियों पर कुछ नियंत्रण स्थापित करने का प्रयास हुआ।
ऐतिहासिक महत्व
यह पहली बार था जब ब्रिटिश Parliament ने भारत में East India Company के प्रशासन में प्रत्यक्ष हस्तक्षेप किया।
1773 = British Parliament's direct regulatory intervention in Company's Indian administration
Regulating Act, 1773 ने भारत में पूर्ण constitutional government स्थापित नहीं किया था। यह मुख्यतः East India Company के शासन को नियंत्रित करने का ब्रिटिश संसदीय प्रयास था।
5. Pitt's India Act, 1784
Regulating Act की कमियों को दूर करने के लिए Pitt's India Act पारित किया गया।
इसने Company के commercial functions और political/administrative functions के बीच अधिक स्पष्ट अंतर स्थापित किया।
प्रमुख विशेषता
Board of Control की स्थापना के माध्यम से ब्रिटिश सरकार ने Company के राजनीतिक मामलों पर प्रभावी नियंत्रण स्थापित किया।
इस प्रकार:
Court of Directors → Commercial affairs
Board of Control → Political affairs
Pitt's India Act को भारत में dual control system के विकास से जोड़ा जाता है।
6. Charter Acts
6.1 Charter Act, 1813
इस Act का महत्व Company के व्यापारिक monopoly में परिवर्तन से जुड़ा है।
प्रमुख बिंदु
- भारत के साथ Company का व्यापारिक monopoly काफी हद तक समाप्त हुआ।
- China trade तथा tea trade से संबंधित monopoly बाद में भी बनी रही।
- शिक्षा के लिए सरकारी संसाधनों से धन उपलब्ध कराने का प्रावधान किया गया।
महत्व
यह Act भारत में शिक्षा और missionary activity के संदर्भ में भी महत्वपूर्ण है।
7. Charter Act, 1833
यह औपनिवेशिक constitutional development का अत्यंत महत्वपूर्ण चरण था।
प्रमुख विशेषताएँ
1. Governor-General of Bengal → Governor-General of India
इससे पूरे British India के प्रशासन में centralisation को बढ़ावा मिला।
2. Legislative centralisation
Governor-General-in-Council को पूरे British India के लिए legislative authority प्राप्त हुई।
3. Company का commercial character समाप्त
East India Company का व्यापारिक कार्य लगभग समाप्त कर दिया गया और वह मुख्यतः administrative agency बन गई।
4. Law Commission
एक Law Commission की व्यवस्था की गई, जिसे भारतीय कानूनों के systematic development से जोड़ा जाता है।
Charter Act 1833 को भारत में legislative centralisation के विकास के लिए विशेष रूप से याद रखें।
8. Charter Act, 1853
यह Company शासन के अंतिम चरण का महत्वपूर्ण constitutional development था।
प्रमुख विशेषताएँ
- Governor-General's Council के legislative और executive functions में अधिक स्पष्ट distinction विकसित हुआ।
- Legislative Council के विस्तार की दिशा में कदम उठाया गया।
- Civil services में merit-based recruitment की दिशा में महत्वपूर्ण विकास हुआ।
महत्वपूर्ण परीक्षा बिंदु
1853 का Charter Act Company शासन के अंत की ओर constitutional development का अंतिम प्रमुख Charter Act था।
9. Government of India Act, 1858
1857 के विद्रोह के बाद British constitutional arrangement में मूलभूत परिवर्तन हुआ।
मुख्य परिवर्तन
East India Company का शासन समाप्त
और
British Crown का प्रत्यक्ष शासन स्थापित।
Secretary of State for India
भारत के प्रशासन के लिए ब्रिटिश Cabinet में Secretary of State for India का पद स्थापित किया गया।
उसकी सहायता के लिए Council of India का प्रावधान किया गया।
Governor-General
Governor-General को Crown के representative के रूप में Viceroy के रूप में भी जाना जाने लगा।
1858 = Company Rule समाप्त + Crown Rule प्रारंभ
10. Indian Councils Act, 1861
1858 के बाद British administration ने legislative councils के पुनर्गठन की दिशा में कदम उठाए।
प्रमुख बिंदु
- Legislative Councils का विस्तार।
- भारतीयों को legislative councils में शामिल करने का रास्ता खुला।
- Portfolio system के विकास से संबंधित व्यवस्था।
- Legislative decentralisation की दिशा में कदम।
महत्व
यह representative institutions के क्रमिक विकास की दिशा में एक चरण था।
11. Indian Councils Act, 1892
यह प्रतिनिधित्व के विस्तार की दिशा में एक सीमित लेकिन महत्वपूर्ण कदम था।
प्रमुख विशेषताएँ
- Legislative Councils का विस्तार।
- बजट पर चर्चा की सीमित सुविधा।
- प्रश्न पूछने की सीमित व्यवस्था।
- indirect election/representation के तत्वों का विकास।
इसे आधुनिक अर्थ में पूर्ण democratic election न समझें।
12. Indian Councils Act, 1909 — Morley-Minto Reforms
यह constitutional history में विशेष रूप से महत्वपूर्ण है।
प्रमुख विशेषता
Separate Electorates
विशेष रूप से मुसलमानों के लिए separate electorate की व्यवस्था का प्रारंभ हुआ।
महत्व
इससे communal representation institutionalised हुआ और भारतीय electoral politics पर दीर्घकालीन प्रभाव पड़ा।

13. Government of India Act, 1919 — Montagu-Chelmsford Reforms
1919 का Act भारतीय constitutional development में एक निर्णायक चरण था।
सबसे महत्वपूर्ण विशेषता
Provincial Dyarchy
प्रांतीय विषयों को broadly दो भागों में विभाजित किया गया—
Reserved Subjects
और
Transferred Subjects
Transferred subjects को ministers के माध्यम से administer किया जाता था, जबकि reserved subjects Governor तथा उसके executive machinery के नियंत्रण में रहते थे।
अन्य महत्वपूर्ण विशेषताएँ
- Centre में bicameral legislature की दिशा में विकास।
- Legislative representation का विस्तार।
- Direct elections के क्षेत्र का विस्तार।
- Provincial legislative institutions का विकास।

इसे 1935 के Act से confuse न करें।
14. Government of India Act, 1935
यह भारतीय constitutional development का सबसे महत्वपूर्ण औपनिवेशिक Act क्यों है?
Government of India Act, 1935 ने एक व्यापक constitutional framework प्रस्तुत किया।
इसमें federation की परिकल्पना, provincial autonomy, legislative lists तथा federal-provincial distribution of powers जैसी व्यवस्थाएँ थीं। Act के मूल text में Federal Legislative List, Provincial Legislative List और Concurrent Legislative List का स्पष्ट ढाँचा दिया गया था।
प्रमुख विशेषताएँ
1. All-India Federation की योजना
British Indian Provinces तथा Indian States को federation में शामिल करने की योजना बनाई गई।
हालाँकि proposed federation व्यवहार में उस रूप में लागू नहीं हुई।
2. Provincial Autonomy
प्रान्तों में dyarchy समाप्त करने तथा provincial autonomy को स्थापित करने की दिशा में व्यवस्था की गई।
3. Legislative Lists
तीन legislative lists का ढाँचा:
- Federal List
- Provincial List
- Concurrent List
4. Federal Court
Federal Court की स्थापना का प्रावधान।
5. Bicameralism
कुछ प्रान्तों में bicameral legislatures का प्रावधान।
6. Franchise का विस्तार
मताधिकार का विस्तार हुआ, यद्यपि universal adult franchise नहीं था।
7. Emergency powers
Governor-General और Governors को व्यापक discretionary/emergency powers प्राप्त थीं।
15. Government of India Act, 1935 और भारतीय संविधान
1935 के Act को भारतीय संविधान का “source” कहना सावधानी से समझना चाहिए।
भारतीय संविधान निर्माताओं ने इससे कई institutional/administrative ideas को अपनाया या modified form में इस्तेमाल किया, लेकिन:
भारतीय संविधान Government of India Act, 1935 की केवल पुनरावृत्ति नहीं है।
संविधान सभा ने ब्रिटिश constitutional experience के साथ-साथ भारतीय राजनीतिक अनुभव, स्वतंत्रता आंदोलन, विभिन्न constitutional proposals और comparative constitutional materials का अध्ययन किया।
“भारतीय संविधान 1935 के Act की copy है” — गलत और oversimplified statement।
16. Indian Independence Act, 1947
भारत की स्वतंत्रता और विभाजन की constitutional framework इसी Act से संबंधित थी।
प्रमुख परिणाम
- British Parliament की Indian constitutional authority समाप्त होने की प्रक्रिया प्रारंभ हुई।
- दो Dominions — India और Pakistan — की स्थापना का constitutional framework बना।
- British Crown की Indian States पर paramountcy समाप्त हुई।
- Constituent Assemblies को constitutional authority प्राप्त हुई।

18. भारतीयों द्वारा संविधान की मांग का विकास
भारतीय संविधान का निर्माण केवल British reforms का परिणाम नहीं था।
भारतीय राष्ट्रीय आंदोलन के दौरान भारतीयों ने स्वयं constitutional self-government की मांग विकसित की।
महत्वपूर्ण milestones
19. संविधान सभा की मांग
भारत के लिए संविधान सभा का विचार भारतीय राजनीतिक चिंतन में धीरे-धीरे विकसित हुआ।
इस संदर्भ में M.N. Roy का नाम महत्वपूर्ण है। बाद में भारतीय राष्ट्रीय आंदोलन में संविधान सभा की मांग व्यापक राजनीतिक मांग बनी।
परीक्षा दृष्टि
यह distinction याद रखें:
Constituent Assembly का विचार और उसका वास्तविक गठन एक ही घटना नहीं थे।
वास्तविक Constituent Assembly का गठन Cabinet Mission Plan, 1946 के आधार पर हुआ।
20. Cabinet Mission Plan, 1946
Constituent Assembly के गठन का तत्काल constitutional basis Cabinet Mission Plan था।
Assembly के सदस्य direct universal adult franchise से निर्वाचित नहीं हुए थे।
Cabinet Mission scheme के अनुसार:
- Provincial Legislative Assemblies के elected members द्वारा representatives का election हुआ।
- Princely States के representatives nomination/selection के माध्यम से आए।
- Chief Commissioners' Provinces के लिए भी representation की व्यवस्था थी।
एक constitutional-history archive के अनुसार Cabinet Mission Plan के तहत प्रारंभिक कुल strength 389 थी—292 representatives from provinces, 93 from Princely States और 4 from Chief Commissioners' Provinces। Partition के बाद यह संख्या 299 रह गई।

22. क्या संविधान सभा पूर्णतः प्रत्यक्ष निर्वाचित थी?
नहीं।
यह RAS Prelims का अत्यंत महत्वपूर्ण trap है।
संविधान सभा के अधिकांश सदस्य provincial legislative assemblies के elected members द्वारा अप्रत्यक्ष रूप से चुने गए थे।
इसलिए:
Constituent Assembly = indirectly elected body + princely-state representation
इसे universal adult franchise से directly elected body कहना गलत होगा।
23. संविधान सभा की पहली बैठक
9 December 1946
Constituent Assembly की पहली बैठक New Delhi के Constitution Hall में हुई।
Dr. Sachchidananda Sinha को temporary Chairman बनाया गया। Official Constituent Assembly proceedings में 9 December 1946 की पहली बैठक और Sinha के temporary Chairman के रूप में chair लेने का रिकॉर्ड उपलब्ध है।

24. स्थायी अध्यक्ष
11 December 1946 को Dr. Rajendra Prasad को Constituent Assembly का permanent Chairman/President चुना गया। उसी दिन Assembly ने Rules of Procedure से संबंधित कार्य भी किया।

25. Constitutional Adviser — B. N. Rau
Sir B. N. Rau Constituent Assembly के Constitutional Adviser थे।
उनकी भूमिका अत्यंत महत्वपूर्ण थी क्योंकि उन्होंने Assembly के committee reports और decisions को एक working constitutional draft में consolidate करने का कार्य किया।
October 1947 में तैयार उनका draft 240 Articles, 25 Parts और 13 Schedules वाला था और यह Drafting Committee के लिए महत्वपूर्ण आधार बना।
B. N. Rau = Constitutional Adviser
उन्हें Drafting Committee का Chairman न समझें।
26. Objectives Resolution
13 December 1946 को Jawaharlal Nehru ने Objectives Resolution प्रस्तुत किया।
इस Resolution ने संविधान-निर्माण के broad philosophical objectives निर्धारित किए।
22 January 1947 को इसे Constituent Assembly ने adopt किया।
महत्व
Objectives Resolution ने बाद में संविधान की philosophical orientation, विशेषकर sovereignty, democracy और constitutional objectives के विकास में महत्वपूर्ण भूमिका निभाई।

27. संविधान सभा की समितियाँ
संविधान निर्माण को practical और systematic बनाने के लिए Assembly ने विभिन्न committees का गठन किया।
इन committees ने अलग-अलग constitutional subjects पर preliminary deliberation की और reports प्रस्तुत कीं।
Constitution-making archive के अनुसार committees constitution-making process का महत्वपूर्ण institutional component थीं और उनके reports पर Assembly की plenary debates का बड़ा हिस्सा आधारित था।

29. Drafting Committee — गठन 29 August 1947
Constituent Assembly ने 29 August 1947 को Drafting Committee नियुक्त की।
Original committee में सात सदस्य थे:
- B. R. Ambedkar
- Alladi Krishnaswami Ayyar
- N. Gopalaswami Ayyangar
- K. M. Munshi
- Mohammad Saadulla
- B. L. Mitter
- D. P. Khaitan
29 August 1947 की Assembly proceedings में committee के गठन और उसके mandate को स्पष्ट रूप से दर्ज किया गया है।
Chairman: Dr. B. R. Ambedkar
मुख्य कार्य: Drafting Committee का कार्य Assembly के decisions और available draft material को scrutinise करके Constitution का draft तैयार करना था।
30. B. N. Rau Draft और Drafting Committee में अंतर
यह बहुत महत्वपूर्ण conceptual distinction है।

B. N. Rau का draft लगभग 240 Articles और 13 Schedules के साथ एक working compilation था। बाद में Drafting Committee ने उसे scrutinise और modify किया।
31. Draft Constitution, 1948
Drafting Committee ने 21 February 1948 को Draft Constitution को President of the Constituent Assembly को submit किया।
1948 के Draft में:
- 315 Articles
- 18 Parts
- 8 Schedules
थे।
यह पहला ऐसा draft था जो व्यापक public circulation के लिए उपलब्ध हुआ।
32. Draft Constitution का Public Circulation
Draft Constitution को केवल Assembly members तक सीमित नहीं रखा गया।
इसे व्यापक रूप से circulate किया गया ताकि:
- members
- provincial governments
- central ministries
- courts
- public
से comments और suggestions प्राप्त किए जा सकें।
इसके बाद Drafting Committee ने प्राप्त टिप्पणियों पर विचार किया और आवश्यक changes किए।
33. Draft Constitution का Assembly में Introduction — 4 November 1948
Dr. B. R. Ambedkar ने Draft Constitution को Constituent Assembly में formally introduce किया।
उन्होंने Draft Constitution को Assembly के consideration के लिए प्रस्तुत किया।
34. संविधान निर्माण की बहु-स्तरीय प्रक्रिया
भारत का संविधान एक व्यक्ति या केवल Drafting Committee द्वारा नहीं बनाया गया।
इसे इस flow से समझें:
यह distinction RAS के लिए अत्यंत महत्वपूर्ण है।
35. संविधान सभा में संशोधन प्रक्रिया
Draft Constitution पर व्यापक debate हुई।
Assembly members ने provisions पर amendments प्रस्तावित किए और कई provisions पर detailed discussion हुई।
इसलिए संविधान को केवल Drafting Committee का product कहना अधूरा है।
संविधान का अंतिम रूप Assembly की deliberative process का परिणाम था।
36. संविधान सभा की कार्यप्रणाली
Constituent Assembly ने लगभग:
2 वर्ष 11 महीने
कार्य किया।
Constitution-making archive के अनुसार Assembly ने 11 sessions में कार्य किया और लगभग 167 days की plenary sittings में संविधान-निर्माण की प्रक्रिया पूरी की।
Important: यहाँ “2 years 11 months” को 9 December 1946 से 26 November 1949 तक Constitution-making phase के संदर्भ में समझना चाहिए; Assembly का अंतिम sitting phase 24 January 1950 तक चला।
37. 26 November 1949 — Adoption
26 November 1949 को Constituent Assembly ने Constitution के final text को adopt/enact करने की प्रक्रिया पूरी की।
Third reading इसी दिन समाप्त हुई और Assembly ने Constitution को स्वीकार किया।
26 November 1949 = Constitution adopted
लेकिन:
26 January 1950 = Constitution came into force
दोनों को कभी interchange न करें।
38. 24 January 1950 — Signing
24 January 1950 को Constituent Assembly की अंतिम बैठक में Constitution की copies पर members ने signatures किए।
उसी दिन Dr. Rajendra Prasad को भारत का प्रथम President निर्वाचित घोषित किया गया।
Assembly proceedings में Constitution की English handwritten, English printed और Hindi handwritten copies पर signatures का रिकॉर्ड मिलता है।
39. 26 January 1950 — Commencement
26 January 1950 को Constitution प्रभावी हुआ और भारत गणराज्य बना।
यह date इसलिए भी चुनी गई क्योंकि 26 January का संबंध भारतीय राष्ट्रीय आंदोलन में Purna Swaraj के ऐतिहासिक commitment से था।

जब Constitution 26 November 1949 को adopted हुआ, तब इसमें:
395 Articles

थे।
यह original Constitution की स्थिति थी।
आज के Constitution में amendments के कारण numbering और structure में कई परिवर्तन हो चुके हैं।

इस distinction को हमेशा ध्यान में रखें।
41. संविधान के स्रोत
भारतीय संविधान निर्माताओं ने विभिन्न देशों के constitutional experiences का अध्ययन किया।
लेकिन इसे केवल “borrowed Constitution” कहना गलत है।
सही conceptual understanding:
Indian Constitution = comparative constitutional learning + Indian political experience + freedom movement ideals + Constituent Assembly deliberation

Colonial Acts were the historical background to the making of the Indian Constitution; they were not themselves the Indian Constitution.

Important: Here "2 years 11 months" should be understood in the context of 9 December 1946 to 26 November 1949 as the Constitution-making phase; the Assembly's final sitting phase continued until 24 January 1950.
37. 26 November 1949 — Adoption
On 26 November 1949, the Constituent Assembly completed the process of adopting/enacting the final text of the Constitution.
The Third Reading was completed on the same day, and the Assembly accepted the Constitution.

The making of the Indian Constitution was a multi-level historical and constitutional process.
Its historical background included a long series of British constitutional legislation, among which the Regulating Act of 1773, Pitt's India Act of 1784, the 1909 reforms, the Government of India Act of 1919, and the Government of India Act of 1935 are particularly important.
1919 developed provincial dyarchy, while 1935 presented a comprehensive constitutional framework of provincial autonomy and federal-provincial legislative distribution. The 1935 Act was an important antecedent of Indian constitutional development, but the Indian Constitution is not a mere copy of it.
The actual constitution-making process took place in the Constituent Assembly formed on the basis of the Cabinet Mission Plan. The Assembly's first meeting was on 9 December 1946; Sachchidananda Sinha became temporary Chairman and Rajendra Prasad was later elected permanent President.
