प्रस्तावना एवं संविधान की दार्शनिक आधारभूमि

1. अध्याय का उद्देश्य

भारतीय संविधान केवल शासन चलाने के नियमों का दस्तावेज नहीं है। यह भारत के राजनीतिक, सामाजिक, आर्थिक और नैतिक लक्ष्यों को भी निर्धारित करता है।

संविधान यह बताता है कि—

इन सभी प्रश्नों का सबसे संक्षिप्त संवैधानिक अभिव्यक्ति प्रस्तावना (Preamble) में दिखाई देती है।

इसलिए:

प्रस्तावना भारतीय संविधान के मूल उद्देश्यों, मूल्यों और दर्शन का संक्षिप्त संवैधानिक परिचय है।

लेकिन एक महत्वपूर्ण सावधानी:

प्रस्तावना स्वयं किसी स्वतंत्र विधायी या कार्यकारी शक्ति का स्रोत नहीं है और सामान्यतः अपने आप में प्रवर्तनीय अधिकार प्रदान नहीं करती।

3. प्रस्तावना क्या है?

प्रस्तावना संविधान के प्रारंभ में दिया गया वह संवैधानिक वक्तव्य है जिसमें संविधान के मूल उद्देश्य, राज्य के स्वरूप और नागरिकों के लिए निर्धारित प्रमुख आदर्शों को व्यक्त किया गया है।

भारतीय संविधान की प्रस्तावना की शुरुआत इन शब्दों से होती है:

“हम, भारत के लोग...”

यह वाक्य अत्यंत महत्वपूर्ण है क्योंकि यह संविधान की सत्ता और वैधता को भारतीय जनता से जोड़ता है।

प्रस्तावना में भारत को पाँच प्रमुख विशेषणों द्वारा परिभाषित किया गया है:

  1. सम्प्रभु (Sovereign)
  2. समाजवादी (Socialist)
  3. पंथनिरपेक्ष (Secular)
  4. लोकतांत्रिक (Democratic)
  5. गणराज्य (Republic)

इसके बाद संविधान के प्रमुख लक्ष्यों को बताया गया है:

  1. न्याय
  2. स्वतंत्रता
  3. समानता
  4. बंधुता

4. “हम, भारत के लोग” का अर्थ

प्रस्तावना का आरंभ:

“हम, भारत के लोग”

से होता है।

इसका अर्थ यह नहीं है कि भारत के प्रत्येक नागरिक ने व्यक्तिगत रूप से संविधान लिखा या उस पर हस्ताक्षर किए।

इसका संवैधानिक अर्थ है कि:

संविधान की अंतिम वैधता और संवैधानिक सत्ता का आधार भारतीय जनता है।

संविधान सभा ने भारतीय जनता की ओर से संविधान निर्माण की भूमिका निभाई।

इस अवधारणा को:

जनसत्ता (Popular Sovereignty)

से जोड़ा जाता है।

5. सम्प्रभु — Sovereign

प्रस्तावना भारत को:

“सम्प्रभु”

राज्य घोषित करती है।

सम्प्रभुता का अर्थ

सम्प्रभुता का सामान्य अर्थ है कि भारत किसी बाहरी शक्ति के अधीन नहीं है और अपने आंतरिक तथा बाहरी मामलों में स्वतंत्र निर्णय लेने की क्षमता रखता है।

इसे दो भागों में समझ सकते हैं:

1. आंतरिक सम्प्रभुता

भारत के क्षेत्र के भीतर शासन और कानून की सर्वोच्च संवैधानिक व्यवस्था।

2. बाहरी सम्प्रभुता

किसी विदेशी राज्य के अधीन न होना तथा अंतरराष्ट्रीय मामलों में स्वतंत्र निर्णय लेने की क्षमता।


6. क्या सम्प्रभुता का अर्थ संसद की असीमित शक्ति है?

नहीं।

यह एक महत्वपूर्ण संवैधानिक अंतर है।

भारत में:

संविधान की सर्वोच्चता (Constitutional Supremacy)

का सिद्धांत लागू होता है।

संसद की शक्तियाँ भी संविधान से प्राप्त होती हैं और संविधान द्वारा निर्धारित सीमाओं के अधीन रहती हैं।

इसलिए:

संसद → संविधान के अधीन

न कि:

संविधान → संसद के अधीन

यही कारण है कि भारत में:

महत्वपूर्ण हैं।


7. समाजवादी — Socialist

क्या “समाजवादी” शब्द मूल प्रस्तावना में था?

नहीं।

“समाजवादी” शब्द को:

42वें संविधान संशोधन अधिनियम, 1976

द्वारा प्रस्तावना में जोड़ा गया।

लेकिन इसका यह अर्थ बिल्कुल नहीं है कि 1976 से पहले भारतीय संविधान में सामाजिक और आर्थिक न्याय की अवधारणा मौजूद नहीं थी।

मूल संविधान में पहले से ही:

जैसे तत्व मौजूद थे।

“समाजवादी” शब्द 1976 में जोड़ा गया, लेकिन समाजवादी/कल्याणकारी संवैधानिक अभिमुखता मूल संविधान में पहले से मौजूद थी।


8. भारतीय संदर्भ में समाजवाद

भारतीय संविधान में समाजवाद को किसी एक कठोर आर्थिक मॉडल के रूप में नहीं समझना चाहिए।

भारतीय संवैधानिक समाजवाद का संबंध broadly:

से है।

इसलिए:

भारतीय समाजवाद को केवल राज्य द्वारा सभी आर्थिक गतिविधियों के स्वामित्व के रूप में समझना गलत होगा।


9. पंथनिरपेक्ष — Secular

क्या “पंथनिरपेक्ष” शब्द मूल प्रस्तावना में था?

नहीं।

इसे भी:

42वें संविधान संशोधन अधिनियम, 1976

द्वारा प्रस्तावना में जोड़ा गया।

लेकिन धार्मिक स्वतंत्रता और धार्मिक समानता से संबंधित संवैधानिक प्रावधान मूल संविधान में पहले से मौजूद थे।

विशेष रूप से:

भारतीय पंथनिरपेक्ष व्यवस्था को समझने में महत्वपूर्ण हैं।


10. भारतीय पंथनिरपेक्षता की विशेषता

भारतीय पंथनिरपेक्षता को केवल:

“राज्य और धर्म के बीच पूर्ण अलगाव”

के रूप में समझना पर्याप्त नहीं है।

भारतीय संवैधानिक व्यवस्था में:

सभी शामिल हैं।

इसलिए भारतीय पंथनिरपेक्षता को broadly:

सभी नागरिकों के लिए समान संवैधानिक सम्मान तथा धार्मिक स्वतंत्रता की व्यवस्था

के रूप में समझना अधिक उपयुक्त है।


11. लोकतांत्रिक — Democratic

भारत एक:

लोकतांत्रिक गणराज्य

है।

लोकतंत्र केवल चुनाव कराने तक सीमित नहीं है।

लोकतांत्रिक व्यवस्था के प्रमुख तत्व हैं:


12. क्या लोकतंत्र का अर्थ केवल बहुमत का शासन है?

नहीं।

भारत में:

संवैधानिक लोकतंत्र (Constitutional Democracy)

की व्यवस्था है।

इसका अर्थ है:

बहुमत का शासन + संविधान की सीमाएँ + मौलिक अधिकार + कानून का शासन + संस्थागत नियंत्रण

इसलिए संसद या बहुमत:


13. गणराज्य — Republic

“गणराज्य” का मूल अर्थ है:

भारत का राष्ट्राध्यक्ष वंशानुगत राजा नहीं है।

भारत में राष्ट्राध्यक्ष:

राष्ट्रपति

है।

राष्ट्रपति का पद वंशानुगत नहीं है और उसका निर्वाचन संवैधानिक प्रक्रिया के माध्यम से होता है।

गणराज्य का अर्थ यह नहीं है कि राष्ट्रपति का चुनाव सीधे सभी नागरिक करते हैं।

भारत में राष्ट्रपति का निर्वाचन एक निर्वाचक मंडल द्वारा किया जाता है।


14. न्याय — Justice

प्रस्तावना तीन प्रकार के न्याय की बात करती है:

1. सामाजिक न्याय

समाज में मौजूद सामाजिक असमानताओं और भेदभाव को कम करना।

2. आर्थिक न्याय

आर्थिक अवसरों और संसाधनों से संबंधित अत्यधिक असमानताओं को कम करने की संवैधानिक दिशा।

3. राजनीतिक न्याय

राजनीतिक प्रक्रिया में समान भागीदारी और अवसर।

न्याय = सामाजिक + आर्थिक + राजनीतिक


15. सामाजिक न्याय

सामाजिक न्याय का उद्देश्य केवल कानूनी समानता देना नहीं है।

इसमें सामाजिक रूप से वंचित समूहों को वास्तविक अवसर उपलब्ध कराने की दिशा भी शामिल है।

उदाहरण:

इसलिए:

सामाजिक न्याय = समानता + सामाजिक असमानताओं को कम करने का प्रयास


16. आर्थिक न्याय

आर्थिक न्याय का संबंध:

से है।

इसका व्यापक संवैधानिक आधार प्रस्तावना के साथ-साथ राज्य के नीति-निदेशक तत्वों में मिलता है।


17. राजनीतिक न्याय

राजनीतिक न्याय का अर्थ है कि नागरिकों को राजनीतिक व्यवस्था में भाग लेने के अवसर उपलब्ध हों।

इसमें:

महत्वपूर्ण हैं।


18. स्वतंत्रता — Liberty

प्रस्तावना नागरिकों को निम्न क्षेत्रों में स्वतंत्रता का लक्ष्य देती है:

महत्वपूर्ण

यह स्वतंत्रता पूर्ण और असीमित नहीं है।

मौलिक अधिकारों के अंतर्गत संविधान स्वयं कुछ युक्तिसंगत प्रतिबंधों (Reasonable Restrictions) की अनुमति देता है।


19. विचार और अभिव्यक्ति की स्वतंत्रता

विचार

व्यक्ति के विचार और बौद्धिक स्वतंत्रता से संबंधित है।

अभिव्यक्ति

अपने विचारों को व्यक्त करने की स्वतंत्रता।

इसका प्रमुख संवैधानिक आधार:

अनुच्छेद 19(1)(क)

है।

लेकिन अनुच्छेद 19(2) के अंतर्गत कुछ संवैधानिक आधारों पर युक्तिसंगत प्रतिबंध लगाए जा सकते हैं।


20. विश्वास, श्रद्धा और उपासना

ये शब्द व्यक्ति की धार्मिक और अंतःकरण संबंधी स्वतंत्रता से जुड़े हैं।

इनका विस्तृत संवैधानिक ढाँचा:

अनुच्छेद 25 से 28

में मिलता है।

इसलिए प्रस्तावना को अकेले पढ़ना उचित नहीं है।

इसे:

प्रस्तावना → मौलिक अधिकार → नीति-निदेशक तत्व → संवैधानिक संरचना

के साथ पढ़ना चाहिए।


21. समानता — Equality

प्रस्तावना समानता को दो आयामों से जोड़ती है:

1. प्रतिष्ठा की समानता

सभी नागरिकों की संवैधानिक प्रतिष्ठा और स्थिति का समान महत्व।

2. अवसर की समानता

अवसरों में समानता।

इसका विस्तृत संवैधानिक आधार मुख्यतः:

अनुच्छेद 14 से 18

में मिलता है।


22. क्या समानता का अर्थ सभी के साथ बिल्कुल एक जैसा व्यवहार है?

नहीं।

संवैधानिक समानता का अर्थ:

समान परिस्थितियों वाले व्यक्तियों के साथ समान व्यवहार तथा वास्तविक और प्रासंगिक अंतर होने पर संवैधानिक रूप से उचित वर्गीकरण की अनुमति।

इसलिए:

समानता ≠ यांत्रिक समान व्यवहार

कभी-कभी वास्तविक समानता प्राप्त करने के लिए अलग-अलग परिस्थितियों वाले व्यक्तियों के साथ अलग व्यवहार आवश्यक हो सकता है।


23. बंधुता — Fraternity

बंधुता का अर्थ केवल सामाजिक भाईचारा नहीं है।

यह:

से संबंधित है।

प्रस्तावना बंधुता को दो महत्वपूर्ण तत्वों से जोड़ती है:

व्यक्ति की गरिमा

और

राष्ट्र की एकता एवं अखंडता


24. व्यक्ति की गरिमा — Dignity of the Individual

व्यक्ति की गरिमा का अर्थ है कि प्रत्येक व्यक्ति का अपना अंतर्निहित मूल्य और सम्मान है।

यह आधुनिक संवैधानिक न्यायशास्त्र (Constitutional Jurisprudence) में अत्यंत महत्वपूर्ण अवधारणा है।

विशेष रूप से जीवन और व्यक्तिगत स्वतंत्रता से संबंधित न्यायिक व्याख्याओं में गरिमा को महत्वपूर्ण स्थान मिला है।


25. राष्ट्र की एकता एवं अखंडता

मूल प्रस्तावना में:

“राष्ट्र की एकता”

का उल्लेख था।

42वें संविधान संशोधन अधिनियम, 1976 द्वारा इसे:

“राष्ट्र की एकता और अखंडता”

किया गया।

“अखंडता” (Integrity) शब्द 42वें संशोधन द्वारा जोड़ा गया।


26. उद्देशिका संकल्प और प्रस्तावना

यह Chapter 2 का अत्यंत महत्वपूर्ण संबंध है।

27. उद्देशिका संकल्प — मुख्य महत्व

उद्देशिका संकल्प ने संविधान-निर्माण के लिए व्यापक वैचारिक दिशा प्रदान की।

इसमें broadly:

जैसे संवैधानिक उद्देश्यों की दिशा दिखाई देती है।

इसलिए:

उद्देशिका संकल्प को प्रस्तावना की दार्शनिक पृष्ठभूमि समझने का महत्वपूर्ण स्रोत माना जाता है।

लेकिन दोनों को एक ही दस्तावेज नहीं समझना चाहिए।

29. क्या प्रस्तावना संविधान का भाग है?

यह प्रश्न संवैधानिक इतिहास में न्यायिक विकास से जुड़ा है।

प्रारंभिक न्यायिक दृष्टिकोण

Berubari Union Reference, 1960

प्रारंभिक दृष्टिकोण में सर्वोच्च न्यायालय ने प्रस्तावना को संविधान का स्वतंत्र प्रवर्तनीय भाग नहीं माना और इसे शक्ति का स्वतंत्र स्रोत नहीं माना।

लेकिन बाद में न्यायिक दृष्टिकोण विकसित हुआ।


30. Kesavananda Bharati बनाम केरल राज्य, 1973

यह भारतीय संवैधानिक कानून के सबसे महत्वपूर्ण मामलों में से एक है।

31. मूल संरचना सिद्धांत — Basic Structure Doctrine

इस सिद्धांत का अर्थ है:

संसद संविधान में संशोधन कर सकती है, लेकिन संशोधन की शक्ति का प्रयोग संविधान की मूल पहचान और मूल संरचना को नष्ट करने के लिए नहीं किया जा सकता।

यह सिद्धांत संविधान के अनुच्छेद 368 की संशोधन शक्ति पर न्यायिक रूप से विकसित सीमा से संबंधित है।


32. मूल संरचना में क्या-क्या शामिल है?

सर्वोच्च न्यायालय के विभिन्न निर्णयों में मूल संरचना के अंतर्गत अलग-अलग constitutional features की पहचान की गई है।

महत्वपूर्ण उदाहरण:

महत्वपूर्ण सावधानी

मूल संरचना की कोई एक अंतिम और बंद सूची संविधान में लिखी हुई नहीं है।

यह न्यायिक व्याख्या द्वारा विकसित सिद्धांत है।

34. Minerva Mills बनाम भारत संघ — 1980

यह मामला संविधान संशोधन शक्ति की सीमाओं और संविधान के मूल संतुलन से संबंधित महत्वपूर्ण निर्णय है।

न्यायालय ने इस विचार को मजबूत किया कि:

संविधान संशोधन की शक्ति स्वयं असीमित नहीं हो सकती।

यह मामला:

के संबंध को समझने में महत्वपूर्ण है।


35. प्रस्तावना और संविधान संशोधन

क्या प्रस्तावना में संशोधन हो सकता है?

हाँ।

Kesavananda Bharati के बाद यह संवैधानिक स्थिति स्वीकार की गई कि प्रस्तावना में संशोधन संभव है।

लेकिन:

संशोधन संविधान की मूल संरचना को नष्ट नहीं कर सकता।


36. 42वाँ संविधान संशोधन अधिनियम, 1976

प्रस्तावना के लिए सबसे महत्वपूर्ण संशोधनों में से एक।

इसने तीन प्रमुख textual changes किए:

1. “समाजवादी” जोड़ा गया

2. “पंथनिरपेक्ष” जोड़ा गया

3. “एकता” को “एकता और अखंडता” किया गया

37. क्या 42वें संशोधन ने भारत को पहली बार पंथनिरपेक्ष बनाया?

ऐसा कहना सही नहीं होगा।

भारत के मूल संविधान में पहले से:

जैसे प्रावधान मौजूद थे।

42वें संशोधन ने:

“पंथनिरपेक्ष” शब्द को प्रस्तावना में स्पष्ट रूप से जोड़ा।


38. संवैधानिकता — Constitutionalism

संविधान

राज्य की मूल कानूनी व्यवस्था।

संवैधानिकता

यह व्यापक सिद्धांत है कि:

सरकार की शक्ति स्वयं संविधान द्वारा सीमित होती है।

संवैधानिकता में:

महत्वपूर्ण हैं।


39. कानून का शासन — Rule of Law

कानून के शासन का मूल अर्थ है:

सरकार और नागरिक दोनों कानून के अधीन हैं।

इसके प्रमुख तत्व:

भारतीय संविधान में कानून का शासन संवैधानिक शासन व्यवस्था का महत्वपूर्ण आधार है।


40. शक्तियों का विभाजन — Separation of Powers

भारत में शक्तियों का पूर्ण और कठोर पृथक्करण नहीं है।

इसके बजाय:

के बीच कार्यों का संवैधानिक विभाजन तथा परस्पर नियंत्रण और संतुलन की व्यवस्था है।

भारत में शक्तियों का पूर्ण पृथक्करण है।

❌ गलत।

सही:

भारत में कार्यात्मक विभाजन तथा नियंत्रण एवं संतुलन की व्यवस्था है।


41. संविधान की सर्वोच्चता — Constitutional Supremacy

भारतीय व्यवस्था में:

संविधान > सामान्य कानून

यदि कोई सामान्य कानून संविधान के विरुद्ध है तो उसकी संवैधानिक वैधता न्यायिक पुनरावलोकन के अधीन हो सकती है।

इसीलिए भारत में:

संसदीय शासन

और

संवैधानिक सर्वोच्चता

दोनों साथ काम करते हैं।


42. लोकतांत्रिक गणराज्य

प्रस्तावना के दो शब्दों को साथ पढ़ें:

लोकतांत्रिक

जनता की भागीदारी और प्रतिनिधि शासन।

गणराज्य

वंशानुगत राष्ट्राध्यक्ष का अभाव।

इसलिए:

भारत = लोकतांत्रिक + गणराज्य


43. प्रस्तावना और मौलिक अधिकार

प्रस्तावना के:

जैसे मूल्यों का विस्तृत संवैधानिक संरक्षण मौलिक अधिकारों में दिखाई देता है।

इसे इस प्रकार समझें:

प्रस्तावना
मूल संवैधानिक मूल्य
मौलिक अधिकार
न्यायिक संरक्षण

44. प्रस्तावना और नीति-निदेशक तत्व

प्रस्तावना में:

जैसे लक्ष्य हैं।

राज्य के नीति-निदेशक तत्व इन लक्ष्यों को शासन और नीति-निर्माण के क्षेत्र में आगे बढ़ाते हैं।

इसलिए:

प्रस्तावना = व्यापक संवैधानिक लक्ष्य

नीति-निदेशक तत्व = शासन में उन लक्ष्यों को प्राप्त करने की दिशा


45. प्रस्तावना और मौलिक कर्तव्य

42वें संशोधन के बाद मौलिक कर्तव्यों को संविधान में जोड़ा गया।

प्रस्तावना के:

जैसे मूल्यों और मौलिक कर्तव्यों के बीच वैचारिक संबंध है।


46. भारतीय संविधान का मूल चरित्र

प्रस्तावना और संविधान की समग्र संरचना से भारत के संवैधानिक चरित्र को निम्न रूप में समझा जा सकता है:
