राज्यपाल
1. राज्यपाल कौन है?
राज्यपाल (Governor) राज्य का संवैधानिक प्रमुख (Constitutional Head) होता है।
जिस प्रकार केंद्र में राष्ट्रपति (President) संघ का संवैधानिक प्रमुख है, उसी प्रकार राज्य में राज्यपाल (Governor) संवैधानिक प्रमुख होता है।
लेकिन राज्य की वास्तविक राजनीतिक कार्यपालिका मुख्यमंत्री और मंत्रिपरिषद (Chief Minister and Council of Ministers) होती है।

2. राज्यपाल से संबंधित संवैधानिक प्रावधान
राज्यपाल से संबंधित मुख्य प्रावधान अनुच्छेद 153 से 162 के बीच हैं।
लेकिन राज्यपाल की शक्तियों को समझने के लिए आगे के कई अनुच्छेद भी महत्वपूर्ण हैं।

4. प्रत्येक राज्य में राज्यपाल — अनुच्छेद 153
संविधान कहता है: प्रत्येक राज्य के लिए एक राज्यपाल (Governor) होगा।
लेकिन: एक ही व्यक्ति दो या अधिक राज्यों का राज्यपाल भी बनाया जा सकता है।
प्रत्येक राज्य के लिए अलग-अलग व्यक्ति का राज्यपाल होना अनिवार्य है।
❌ गलत।
एक व्यक्ति एक से अधिक राज्यों का राज्यपाल हो सकता है।
5. राज्यपाल की नियुक्ति — अनुच्छेद 155
राज्यपाल की नियुक्ति राष्ट्रपति (President) करता है।
लेकिन: राष्ट्रपति अपनी स्वतंत्र राजनीतिक पसंद से संवैधानिक रूप से बाध्यकारी प्रक्रिया में नियुक्ति नहीं करता; व्यवहार में यह केंद्रीय मंत्रिपरिषद की सलाह से होती है।

6. क्या राज्यपाल जनता द्वारा चुना जाता है?
❌ नहीं।
राज्यपाल प्रत्यक्ष निर्वाचन (Direct Election) से नहीं चुना जाता।
बल्कि राष्ट्रपति द्वारा नियुक्त किया जाता है।
7. राज्यपाल के लिए निर्वाचन क्यों नहीं?
संविधान निर्माताओं ने राज्यपाल के प्रत्यक्ष निर्वाचन के बजाय नियुक्ति प्रणाली (Appointment System) को अपनाया।
इसका उद्देश्य था:
- राज्यपाल को दलगत चुनावी राजनीति से दूर रखना;
- राज्य और संघ के बीच संवैधानिक संबंध बनाए रखना;
- राज्य में संवैधानिक व्यवस्था की रक्षा करना।
8. राज्यपाल की योग्यता — अनुच्छेद 157
राज्यपाल बनने के लिए व्यक्ति:
- भारत का नागरिक होना चाहिए।
- उसकी आयु कम-से-कम 35 वर्ष होनी चाहिए।
राज्यपाल (Governor) = भारतीय नागरिक + 35 वर्ष
9. क्या राज्यपाल के लिए कोई शैक्षणिक योग्यता है?
❌ नहीं।
संविधान में स्नातक, कानून या किसी अन्य शैक्षणिक डिग्री की अनिवार्यता नहीं है।
10. क्या राज्यपाल को संबंधित राज्य का निवासी होना चाहिए?
❌ नहीं।
संविधान में जिस राज्य का राज्यपाल बनाया जा रहा है, उसी राज्य का निवासी होना आवश्यक नहीं है।

राजस्थान का राज्यपाल बनने के लिए व्यक्ति का राजस्थान का निवासी होना आवश्यक है।
❌ गलत।
12. क्या सांसद या विधायक राज्यपाल बन सकता है?
यदि कोई व्यक्ति संसद या राज्य विधानमंडल का सदस्य है और राज्यपाल नियुक्त किया जाता है, तो: राज्यपाल का पद ग्रहण करते समय उसकी सदस्यता समाप्त मानी जाती है।
13. लाभ का पद
राज्यपाल संसद या किसी राज्य विधानमंडल का सदस्य नहीं हो सकता।
साथ ही कोई अन्य लाभ का पद (Office of Profit) नहीं रख सकता।
14. राज्यपाल का कार्यकाल — अनुच्छेद 156
सामान्यतः 5 वर्ष का कार्यकाल होता है।
लेकिन: राज्यपाल राष्ट्रपति के प्रसादपर्यंत (Pleasure of the President) पद पर रहता है।
इसका अर्थ
राष्ट्रपति राज्यपाल को उसके कार्यकाल की समाप्ति से पहले भी हटा सकता है।
15. क्या राज्यपाल का कार्यकाल निश्चित 5 वर्ष है?
❌ नहीं।
यह RAS का बहुत महत्वपूर्ण प्रश्न है।
सही उत्तर: संवैधानिक रूप से कार्यकाल 5 वर्ष है, लेकिन वह राष्ट्रपति के प्रसादपर्यंत (Pleasure of the President) पर पद धारण करता है।
16. कार्यकाल समाप्त होने के बाद
यदि 5 वर्ष पूरे हो जाएँ लेकिन नया राज्यपाल नियुक्त न हुआ हो: पुराना राज्यपाल तब तक पद पर रह सकता है जब तक उसका उत्तराधिकारी पद ग्रहण न कर ले।
17. क्या राज्यपाल इस्तीफा दे सकता है?
हाँ।
राज्यपाल अपना इस्तीफा राष्ट्रपति को देता है।
राज्यपाल मुख्यमंत्री को इस्तीफा देता है।

18. क्या राज्यपाल को हटाने की महाभियोग प्रक्रिया है?

20. शपथ — अनुच्छेद 159
राज्यपाल की शपथ संबंधित राज्य के उच्च न्यायालय (High Court) के मुख्य न्यायाधीश द्वारा दिलाई जाती है।
यदि मुख्य न्यायाधीश उपलब्ध न हों: उच्च न्यायालय के उपलब्ध वरिष्ठतम न्यायाधीश द्वारा शपथ दिलाई जा सकती है।
21. शपथ में क्या मुख्य बात है?
राज्यपाल संविधान और कानून की रक्षा, संरक्षण एवं परिरक्षण करने तथा राज्य की जनता की सेवा और कल्याण के लिए स्वयं को समर्पित करने की शपथ लेता है।
22. अनुच्छेद 154
राज्य की कार्यपालिका शक्ति राज्यपाल में निहित होती है।
लेकिन इसका अर्थ यह नहीं कि राज्यपाल अकेले राज्य का शासन चलाता है।
व्यवहार में मुख्यमंत्री और मंत्रिपरिषद इस शक्ति का राजनीतिक रूप से प्रयोग करते हैं।
23. राज्यपाल और मंत्रिपरिषद — अनुच्छेद 163
राज्यपाल को मुख्यमंत्री की अध्यक्षता वाली मंत्रिपरिषद सहायता और सलाह देती है।
सामान्य नियम
राज्यपाल (Governor) मंत्रिपरिषद की सहायता और सलाह पर कार्य करता है।
लेकिन: कुछ परिस्थितियों में राज्यपाल के पास विवेकाधीन शक्ति (Discretionary Power) होती है।
24. विवेकाधीन शक्ति क्या है?
वह शक्ति जिसमें संविधान राज्यपाल को कुछ परिस्थितियों में अपने विवेक से निर्णय लेने की अनुमति देता है।
लेकिन: "विवेकाधीन शक्ति" का अर्थ मनमानी शक्ति नहीं है।
25. राज्यपाल की प्रमुख विवेकाधीन परिस्थितियाँ
- जब किसी दल को स्पष्ट बहुमत न मिले और मुख्यमंत्री की नियुक्ति करनी हो।
- जब मुख्यमंत्री बहुमत खो दे और स्थिति स्पष्ट हो।
- कुछ विधेयकों को राष्ट्रपति के विचार के लिए आरक्षित करना।

26. Hung Assembly
यदि विधानसभा चुनाव के बाद किसी भी दल को स्पष्ट बहुमत नहीं मिलता, तो Hung Assembly की स्थिति होती है।
ऐसी स्थिति में राज्यपाल उस व्यक्ति को मुख्यमंत्री नियुक्त करता है जो सदन में बहुमत सिद्ध करने की सबसे अधिक संभावना रखता हो।
27. Floor Test
ऐसी परिस्थितियों में सबसे महत्वपूर्ण सिद्धांत सदन का परीक्षण (Floor Test) है।
अर्थात: मुख्यमंत्री का बहुमत राजभवन में नहीं, विधानसभा के पटल पर निर्धारित होना चाहिए।

28. राज्यपाल का मुख्यमंत्री से संबंध — अनुच्छेद 164
मुख्यमंत्री की नियुक्ति राज्यपाल करता है।
अन्य मंत्रियों की नियुक्ति मुख्यमंत्री की सलाह पर राज्यपाल करता है।
29. मुख्यमंत्री कौन बनता है?
सामान्य स्थिति में: विधानसभा में बहुमत प्राप्त दल/गठबंधन का नेता।

31. मुख्यमंत्री का राज्यपाल के प्रति कर्तव्य — अनुच्छेद 167
मुख्यमंत्री का कर्तव्य है कि वह राज्यपाल को:
- मंत्रिपरिषद के निर्णयों की जानकारी दे।
- राज्य प्रशासन से संबंधित जानकारी उपलब्ध कराए।
- यदि राज्यपाल मांगे तो किसी मंत्री के निर्णय को मंत्रिपरिषद के समक्ष रखे।

राज्यपाल कुछ विधेयकों को राष्ट्रपति के विचार के लिए सुरक्षित (Reserved) रख सकता है।
