मुख्यमंत्री एवं राज्य मंत्रिपरिषद
1. मुख्यमंत्री कौन है?
मुख्यमंत्री (Chief Minister) राज्य की वास्तविक कार्यपालिका (Real Executive) का प्रमुख होता है।
राज्यपाल (Governor) संवैधानिक प्रमुख (Constitutional Head) होता है, जबकि मुख्यमंत्री वास्तविक राजनीतिक कार्यपालिका का प्रमुख होता है।

3. मुख्यमंत्री को कौन नियुक्त करता है?
राज्यपाल (Governor) मुख्यमंत्री की नियुक्ति करता है।
लेकिन राज्यपाल सामान्यतः विधानसभा में बहुमत प्राप्त दल या गठबंधन के नेता को मुख्यमंत्री नियुक्त करता है।
4. स्पष्ट बहुमत की स्थिति
यदि किसी एक राजनीतिक दल को विधानसभा में स्पष्ट बहुमत मिल जाता है, तो उस दल के नेता को राज्यपाल मुख्यमंत्री नियुक्त करता है।
यहाँ राज्यपाल का विवेक बहुत सीमित होता है।
5. गठबंधन सरकार
यदि चुनाव में कोई दल बहुमत में नहीं है, लेकिन कई दल मिलकर बहुमत का समर्थन प्रस्तुत करते हैं, तो राज्यपाल गठबंधन के उस नेता को मुख्यमंत्री नियुक्त कर सकता है जो विधानसभा में बहुमत सिद्ध करने की स्थिति में हो।
6. त्रिशंकु विधानसभा
यदि किसी भी दल या गठबंधन को स्पष्ट बहुमत नहीं मिलता, तो त्रिशंकु विधानसभा (Hung Assembly) कहलाती है।
ऐसी स्थिति में राज्यपाल की विवेकाधीन भूमिका महत्वपूर्ण हो जाती है।
लेकिन अंतिम कसौटी: विधानसभा का बहुमत है।
7. Floor Test
मुख्यमंत्री के बहुमत पर संदेह होने पर: सदन के पटल पर बहुमत परीक्षण (Floor Test) सबसे महत्वपूर्ण संवैधानिक तरीका है।
बहुमत राजभवन में नहीं, विधानसभा के पटल पर सिद्ध होता है।
8. मुख्यमंत्री की विधानसभा सदस्यता
मुख्यमंत्री विधानसभा का सदस्य हो सकता है।
लेकिन: संविधान यह अनिवार्य नहीं करता कि नियुक्ति के समय वह विधानसभा का सदस्य ही हो।
यदि वह विधानमंडल का सदस्य नहीं है तो 6 महीने के भीतर उसे राज्य विधानमंडल का सदस्य बनना होगा।
अन्यथा: उसे मंत्री/मुख्यमंत्री का पद छोड़ना होगा।
9. 6 माह का नियम — अनुच्छेद 164(4)
यदि कोई मंत्री लगातार 6 महीने तक राज्य विधानमंडल का सदस्य नहीं बनता, तो: वह मंत्री नहीं रह सकता।
यह नियम मुख्यमंत्री पर भी लागू होता है।
मुख्यमंत्री के लिए 6 महीने में लोकसभा सदस्य बनना आवश्यक है।

10. मुख्यमंत्री का कार्यकाल
संविधान मुख्यमंत्री के लिए कोई निश्चित 5-वर्षीय कार्यकाल निर्धारित नहीं करता।
मुख्यमंत्री तब तक पद पर रहता है जब तक उसे विधानसभा का विश्वास प्राप्त है।
11. मुख्यमंत्री कब पद छोड़ता है?
मुख्यमंत्री को:
- बहुमत खोने पर इस्तीफा देना पड़ सकता है।
- अविश्वास प्रस्ताव पारित होने पर।
- विधानसभा चुनाव में सरकार हारने पर।
- स्वेच्छा से इस्तीफा देने पर।
- मृत्यु की स्थिति में।
12. क्या राज्यपाल मुख्यमंत्री को मनमाने ढंग से हटा सकता है?
❌ नहीं।
मुख्यमंत्री की वास्तविक स्थिति विधानसभा के बहुमत पर निर्भर है।
यदि मुख्यमंत्री के पास स्पष्ट बहुमत है: राज्यपाल उसे केवल अपनी इच्छा से नहीं हटा सकता।
13. मुख्यमंत्री का इस्तीफा
मुख्यमंत्री अपना इस्तीफा राज्यपाल को देता है।
मुख्यमंत्री का इस्तीफा पूरी मंत्रिपरिषद के इस्तीफे का कारण बनता है।

14. मंत्रिपरिषद क्या है? — Council of Ministers
मुख्यमंत्री के नेतृत्व में मंत्रियों का समूह राज्य मंत्रिपरिषद कहलाता है।
संविधान के अनुच्छेद 163 के अनुसार: मुख्यमंत्री के नेतृत्व में मंत्रिपरिषद राज्यपाल को उसके कार्यों में सहायता और सलाह देती है।
15. मंत्रिपरिषद और मंत्रिमंडल में अंतर
यह RAS का बहुत महत्वपूर्ण विषय है।
मंत्रिपरिषद (Council of Ministers) एक व्यापक निकाय है।
इसमें कैबिनेट मंत्री, राज्य मंत्री, अन्य मंत्री शामिल होते हैं।
मंत्रिमंडल (Cabinet) मंत्रिपरिषद का छोटा और शक्तिशाली समूह है।
याद रखें
मंत्रिमंडल (Cabinet) ⊂ मंत्रिपरिषद (Council of Ministers)
अर्थात: मंत्रिमंडल, मंत्रिपरिषद का छोटा हिस्सा है।
16. वास्तविक निर्णय कहाँ होते हैं?
राज्य सरकार के अधिकांश महत्वपूर्ण नीतिगत निर्णय, प्रशासनिक निर्णय, वित्तीय निर्णय, राजनीतिक निर्णय मुख्यतः मंत्रिमंडल (Cabinet) के स्तर पर लिए जाते हैं।
17. अन्य मंत्रियों की नियुक्ति कौन करता है?
राज्यपाल (Governor) मुख्यमंत्री की सलाह पर अन्य मंत्रियों की नियुक्ति करता है।

18. क्या मुख्यमंत्री अकेले मंत्री नियुक्त कर सकता है?
❌ नहीं।
औपचारिक नियुक्ति: राज्यपाल करता है।
लेकिन: राजनीतिक/संवैधानिक सलाह मुख्यमंत्री देता है।
19. मंत्रियों का पद
मंत्री राज्यपाल के प्रसादपर्यंत (Pleasure of Governor) पद पर रहता है।
लेकिन इसका व्यावहारिक अर्थ: मुख्यमंत्री के नेतृत्व वाली सरकार और विधानसभा के बहुमत से जुड़ा हुआ है।
20. सामूहिक उत्तरदायित्व — Article 164(2)
राज्य मंत्रिपरिषद विधानसभा के प्रति सामूहिक रूप से उत्तरदायी (Collectively Responsible) होती है।
21. सामूहिक उत्तरदायित्व का अर्थ
यदि विधानसभा में सरकार विश्वास खो देती है, तो: पूरी मंत्रिपरिषद को इस्तीफा देना पड़ता है।
22. Collective Responsibility का मूल सिद्धांत
मंत्रिपरिषद एक टीम की तरह कार्य करती है।
यदि मंत्रिमंडल ने कोई निर्णय लिया: सभी मंत्री सार्वजनिक रूप से उसका समर्थन करते हैं।
यदि कोई मंत्री समर्थन नहीं करता: उसे इस्तीफा देना चाहिए।

23. क्या मंत्रिपरिषद विधान परिषद के प्रति उत्तरदायी है?
❌ नहीं।
यदि राज्य में विधान परिषद है तब भी: मंत्रिपरिषद सामूहिक रूप से विधानसभा के प्रति उत्तरदायी रहती है।
द्विसदनीय राज्य में मंत्रिपरिषद दोनों सदनों के प्रति सामूहिक रूप से उत्तरदायी होती है।
❌ गलत।
24. 15% नियम — अनुच्छेद 164(1A)
राज्य में: मुख्यमंत्री सहित मंत्रियों की कुल संख्या विधानसभा की कुल सदस्य संख्या के 15% से अधिक नहीं हो सकती।
25. न्यूनतम संख्या
मंत्रियों की कुल संख्या मुख्यमंत्री सहित कम-से-कम 12 होनी चाहिए।
इसलिए:
- Maximum = 15%
- Minimum = 12
26. उदाहरण
मान लें विधानसभा में 200 सदस्य हैं।
15%: 200 × 15/100 = 30
अर्थात: अधिकतम 30 मंत्री।
27. राजस्थान में
राजस्थान विधानसभा की कुल निर्वाचित सदस्य संख्या 200 है।
इसलिए: 200 × 15% = 30
अर्थात मुख्यमंत्री सहित राज्य मंत्रिपरिषद में अधिकतम 30 मंत्री हो सकते हैं।

28. 91वाँ संविधान संशोधन
मंत्रियों की संख्या पर 15% सीमा का प्रावधान 91वाँ संविधान संशोधन अधिनियम, 2003 से आया।
इसी संशोधन ने केंद्र और राज्यों दोनों में मंत्रिपरिषद के आकार पर सीमा लगाई।

30. मंत्री को शपथ कौन दिलाता है?
राज्य मंत्री को राज्यपाल (Governor) शपथ दिलाता है।
शपथ के दो प्रमुख रूप:
- पद की शपथ (Oath of Office)
- गोपनीयता की शपथ (Oath of Secrecy)
31. शपथ का संवैधानिक आधार — अनुच्छेद 164(3)
मंत्री पद ग्रहण करने से पहले: राज्यपाल के समक्ष पद और गोपनीयता की शपथ लेता है।
32. मंत्रिपरिषद का नेता
मुख्यमंत्री राज्य मंत्रिपरिषद का नेता होता है।
33. मंत्रियों के विभाग
मुख्यमंत्री मंत्रियों को विभागों के आवंटन में केंद्रीय भूमिका निभाता है।
34. मंत्री को हटाने की स्थिति
यदि मुख्यमंत्री किसी मंत्री से इस्तीफा मांगता है: मंत्री के पद पर बने रहने की राजनीतिक संभावना समाप्त हो जाती है।
व्यवहार में मुख्यमंत्री: राज्यपाल को मंत्री को हटाने की सलाह दे सकता है।
35. मंत्रिपरिषद की बैठक
मुख्यमंत्री मंत्रिपरिषद की बैठकों की अध्यक्षता करता है।
36. राज्य सरकार की नीतियों का समन्वय
मुख्यमंत्री विभिन्न विभागों के बीच समन्वय स्थापित करता है।
37. राज्यपाल और मंत्रिपरिषद के बीच कड़ी
मुख्यमंत्री राज्यपाल और मंत्रिपरिषद के बीच मुख्य संवैधानिक कड़ी है।
38. विधानमंडल में सरकार का नेतृत्व
मुख्यमंत्री विधानसभा में सरकार का राजनीतिक नेतृत्व करता है।
39. विधानसभा भंग करने की सलाह
कुछ परिस्थितियों में मुख्यमंत्री: राज्यपाल को विधानसभा भंग करने की सलाह दे सकता है।
लेकिन: यदि मुख्यमंत्री बहुमत खो चुका हो, तो राज्यपाल संवैधानिक परिस्थितियों के अनुसार निर्णय कर सकता है।
40. Article 167
मुख्यमंत्री का कर्तव्य है कि वह राज्यपाल को:
- मंत्रिपरिषद के निर्णयों की जानकारी दे।
- राज्य प्रशासन से संबंधित जानकारी दे।
- विधायी प्रस्तावों की जानकारी दे।
- राज्यपाल द्वारा मांगी गई सूचना उपलब्ध कराए।
- यदि राज्यपाल आवश्यक समझे तो किसी मंत्री द्वारा लिए गए निर्णय को मंत्रिपरिषद के समक्ष विचार हेतु रखे।
41. Article 167 याद रखने का तरीका
167 = मुख्यमंत्री (CM) → राज्यपाल (Governor) को सूचना
और:
78 = प्रधानमंत्री (PM) → राष्ट्रपति (President) को सूचना
42. मुख्यमंत्री और विधानसभा
मुख्यमंत्री विधानसभा में सरकार का नेता होता है।
वह:
- विधायी कार्यक्रम तय करने में भूमिका निभाता है;
- बजट एवं नीतियों का नेतृत्व करता है;
- विश्वास मत का सामना करता है;
- विपक्ष के प्रश्नों का राजनीतिक उत्तर देता है।
43. विश्वास मत
यदि सरकार के बहुमत पर प्रश्न उठता है: विश्वास मत (Confidence Motion) या Floor Test हो सकता है।
राजस्थान विधानसभा की आधिकारिक वेबसाइट पर भी विभिन्न मुख्यमंत्रियों द्वारा लाए गए Confidence Motions का ऐतिहासिक रिकॉर्ड उपलब्ध है।
44. अविश्वास प्रस्ताव
यदि विपक्ष सरकार के विरुद्ध अविश्वास प्रस्ताव (No-Confidence Motion) लाता है और वह पारित हो जाता है: सरकार को पद छोड़ना पड़ता है।
45. संवैधानिक संबंध
सामान्यतः:
- राज्यपाल (Governor) = नाममात्र/संवैधानिक प्रमुख
- मुख्यमंत्री (Chief Minister) = वास्तविक कार्यपालिका प्रमुख
46. सामान्य स्थिति
राज्यपाल: मंत्रिपरिषद की सहायता और सलाह से कार्य करता है।
यह Article 163 का मूल सिद्धांत है।
47. विवाद की स्थिति
विवाद मुख्यतः इन मामलों में उभर सकता है:

- मुख्यमंत्री के बहुमत पर संदेह

48. न्यायपालिका का सिद्धांत
राज्यपाल: संवैधानिक पदाधिकारी है।
वह: राजनीतिक दल के प्रतिनिधि के रूप में कार्य नहीं कर सकता।
49. राजस्थान के वर्तमान मुख्यमंत्री
वर्तमान में राजस्थान के मुख्यमंत्री: भजनलाल शर्मा हैं।
वे 15 दिसंबर 2023 से मुख्यमंत्री हैं। राजस्थान सरकार के आधिकारिक पोर्टल पर भी उन्हें वर्तमान मुख्यमंत्री के रूप में दर्ज किया गया है।

52. मोहनलाल सुखाड़िया
राजस्थान के इतिहास में सबसे महत्वपूर्ण दीर्घकालीन मुख्यमंत्रियों में से एक थे।
उनका कार्यकाल 1954–1967 तक रहा।
महत्व: उनके लंबे कार्यकाल में कृषि विकास, सिंचाई, सहकारिता, औद्योगिक विकास, पंचायती राज, राजस्थान के संस्थागत विकास को बढ़ावा मिला।
मोहनलाल सुखाड़िया = राजस्थान के सबसे लंबे समय तक मुख्यमंत्री रहने वालों में प्रमुख।
53. पंचायती राज और राजस्थान
राजस्थान का विशेष महत्व: 2 अक्टूबर 1959 को नागौर में भारत में पंचायती राज व्यवस्था के औपचारिक शुभारंभ के कारण है।
इस समय मुख्यमंत्री: मोहनलाल सुखाड़िया थे।

54. बरकतुल्लाह खान
राजस्थान के महत्वपूर्ण मुख्यमंत्रियों में बरकतुल्लाह खान का नाम आता है।
वे: राजस्थान के पहले मुस्लिम मुख्यमंत्री थे।
बरकतुल्लाह खान = राजस्थान के प्रथम मुस्लिम मुख्यमंत्री
55. जगन्नाथ पहाड़िया
जगन्नाथ पहाड़िया राजस्थान के प्रथम दलित मुख्यमंत्री थे।
उनका कार्यकाल 1980–1981 रहा।

56. भैरों सिंह शेखावत
भैरों सिंह शेखावत राजस्थान की राजनीति के अत्यंत महत्वपूर्ण नेता थे।
वे: राजस्थान के प्रथम निर्वाचित भाजपा मुख्यमंत्री माने जाते हैं।
उनके मुख्यमंत्री कार्यकाल:
- पहला: 1977–1980

58. राजस्थान में राष्ट्रपति शासन
राजस्थान में कई बार राष्ट्रपति शासन (President's Rule) लगा है।
इसलिए मुख्यमंत्री सूची पढ़ते समय: केवल मुख्यमंत्रियों के नाम नहीं, बल्कि: President's Rule के अंतराल भी याद करने चाहिए।

अशोक गहलोत राजस्थान के सबसे महत्वपूर्ण समकालीन मुख्यमंत्रियों में हैं।

मंत्रिपरिषद विधानसभा के प्रति सामूहिक रूप से उत्तरदायी है।
64. मंत्रियों की व्यक्तिगत जिम्मेदारी
यदि मुख्यमंत्री किसी मंत्री के संबंध में राज्यपाल को सलाह देता है कि: उस मंत्री को हटाया जाए, तो राज्यपाल: उस सलाह के अनुसार कार्य करता है।
इसलिए: मंत्रियों की व्यक्तिगत स्थिति मुख्यमंत्री की राजनीतिक नेतृत्व क्षमता से जुड़ी है।
65. मंत्रिपरिषद का आकार
- 91वाँ संविधान संशोधन, 2003
- अधिकतम: 15%
- न्यूनतम: 12
66. दलबदल और मंत्री पद
यदि कोई विधायक दसवीं अनुसूची (Tenth Schedule) के तहत दलबदल के कारण अयोग्य घोषित हो जाता है, तो: अनुच्छेद 164(1B) के अनुसार वह निर्धारित अवधि तक मंत्री नियुक्त होने से भी अयोग्य हो सकता है।
यह केवल विधायक की सीट खोने तक सीमित नहीं है।
67. मुख्यमंत्री की शक्ति का आधार
मुख्यमंत्री की शक्ति मुख्यतः तीन चीजों से आती है:
- विधानसभा में बहुमत

But the Governor generally appoints the leader of the majority party or coalition in the Legislative Assembly as Chief Minister.
