1. राज्य विधानमंडल क्या है?
राज्य की कानून बनाने वाली संस्था राज्य विधानमंडल (State Legislature) कहलाती है।
संविधान के अनुसार राज्य विधानमंडल में राज्यपाल + एक या दो सदन हो सकते हैं।

3. राज्य विधानमंडल के दो रूप
भारत में राज्य विधानमंडल एकसदनीय (Unicameral) — केवल विधानसभा हो।
या द्विसदनीय (Bicameral) — विधानसभा + विधान परिषद दोनों हों।
4. वर्तमान में कितने राज्यों में विधान परिषद है?
भारत में वर्तमान में 6 राज्य द्विसदनीय विधानमंडल रखते हैं।
वे हैं:
- आंध्र प्रदेश
- बिहार
- कर्नाटक
- महाराष्ट्र
- तेलंगाना
- उत्तर प्रदेश
राजस्थान में विधान परिषद नहीं है।
राजस्थान एकसदनीय राज्य है।
5. राजस्थान में क्या है?
राजस्थान विधानमंडल: राज्यपाल + राजस्थान विधानसभा से बना है।
राजस्थान में विधान परिषद नहीं है।
6. अनुच्छेद 169
किसी राज्य में विधान परिषद (Legislative Council) का गठन या समाप्ति किया जा सकता है।
लेकिन इसके लिए विशेष प्रक्रिया है।
7. प्रक्रिया
सबसे पहले संबंधित राज्य की विधानसभा एक प्रस्ताव पारित करती है।
इसके लिए कुल सदस्य संख्या का बहुमत और उपस्थित एवं मतदान करने वाले सदस्यों के 2/3 बहुमत दोनों आवश्यक हैं।
इसके बाद संसद कानून बनाती है।
8. क्या विधानसभा स्वयं विधान परिषद बना सकती है?
❌ नहीं।
विधानसभा केवल संसद से गठन/समापन की सिफारिश करने वाला प्रस्ताव पारित करती है।
अंतिम कानून संसद बनाती है।
9. क्या इसके लिए संविधान संशोधन आवश्यक है?
❌ नहीं।
अनुच्छेद 169 के अंतर्गत संसद साधारण कानून द्वारा विधान परिषद का गठन या समाप्ति कर सकती है।
विधान परिषद बनाने के लिए संविधान संशोधन आवश्यक है।
❌ गलत।
10. विधान परिषद की प्रकृति
विधान परिषद राज्य का उच्च सदन (Upper House) है।
विधानसभा राज्य का निम्न/लोकप्रिय सदन (Lower House) है।
लेकिन विधानसभा की तुलना में विधान परिषद की शक्तियाँ अपेक्षाकृत सीमित हैं।
11. विधानसभा क्या है?
विधानसभा राज्य का निर्वाचित लोकप्रिय सदन है।
इसके सदस्य सीधे जनता द्वारा निर्वाचित होते हैं।
12. अनुच्छेद 170
विधानसभा की सदस्य संख्या सामान्यतः 60 से 500 के बीच हो सकती है।
लेकिन कुछ छोटे राज्यों के लिए संविधान में विशेष अपवाद हैं।
13. राजस्थान विधानसभा की सदस्य संख्या
राजस्थान विधानसभा में 200 सदस्य होते हैं।

14. विधानसभा का निर्वाचन
विधानसभा के सदस्य प्रत्यक्ष निर्वाचन (Direct Election) से चुने जाते हैं।
निर्वाचन वयस्क मताधिकार (Adult Suffrage) के आधार पर होता है।
15. विधानसभा का कार्यकाल — अनुच्छेद 172
सामान्य कार्यकाल 5 वर्ष होता है।
यह अवधि पहली बैठक की तारीख से गिनी जाती है।
16. क्या विधानसभा हमेशा 5 वर्ष चलती है?
❌ नहीं।
इसे राज्यपाल मुख्यमंत्री/मंत्रिपरिषद की संवैधानिक स्थिति के अनुसार भंग कर सकता है।
अर्थात: विधानसभा अपना सामान्य 5 वर्ष का कार्यकाल पूरा होने से पहले भी समाप्त हो सकती है।
17. राष्ट्रीय आपातकाल और विधानसभा
यदि राष्ट्रीय आपातकाल (National Emergency) लागू है, तो संसद कानून द्वारा विधानसभा के कार्यकाल को एक बार में अधिकतम 1 वर्ष तक बढ़ा सकती है।
लेकिन: आपातकाल समाप्त होने के बाद 6 महीने से अधिक नहीं।

18. विधानसभा सदस्य बनने की न्यूनतम आयु

- भारत का नागरिक हो;

21. अध्यक्ष — अनुच्छेद 178
विधानसभा अपने सदस्यों में से अध्यक्ष (Speaker) और उपाध्यक्ष (Deputy Speaker) का चुनाव करती है।
22. अध्यक्ष का महत्व
अध्यक्ष विधानसभा की कार्यवाही का संचालन करता है।
उसकी प्रमुख भूमिकाएँ:
- सदन की अध्यक्षता;
- अनुशासन बनाए रखना;
- नियमों की व्याख्या;
- धन विधेयक पर प्रमाणन;
- कुछ संसदीय निर्णयों में भूमिका।
23. अध्यक्ष का कार्यकाल
अध्यक्ष विधानसभा के सदस्य रहते हुए पद पर रह सकता है।
लेकिन: विधानसभा भंग होने के बाद भी नया अध्यक्ष चुने जाने तक पद पर बना रह सकता है।

24. अध्यक्ष का इस्तीफा
अध्यक्ष उपाध्यक्ष को इस्तीफा देता है।
उपाध्यक्ष अध्यक्ष को इस्तीफा देता है।
25. अध्यक्ष को हटाना
अध्यक्ष को विधानसभा के तत्कालीन सभी सदस्यों के बहुमत से पारित प्रस्ताव द्वारा हटाया जा सकता है।
इसके लिए कम से कम 14 दिन का नोटिस आवश्यक है।
26. क्या अध्यक्ष को राज्यपाल हटा सकता है?
❌ नहीं।
अध्यक्ष को विधानसभा हटा सकती है।
27. विधान परिषद की संरचना — अनुच्छेद 171
विधान परिषद की कुल सदस्य संख्या विधानसभा की कुल सदस्य संख्या के 1/3 से अधिक नहीं हो सकती।
और 40 से कम नहीं हो सकती।
28. उदाहरण
यदि विधानसभा में 240 सदस्य हैं, तो विधान परिषद की अधिकतम सदस्य संख्या: 240 ÷ 3 = 80 होगी।
29. विधान परिषद के सदस्य कैसे चुने जाते हैं?
विधान परिषद की विशेषता: इसके सदस्य सीधे जनता द्वारा पूरी तरह निर्वाचित नहीं होते।
इसके विभिन्न वर्गों से सदस्य आते हैं।
- 1/3 — स्थानीय निकाय
- 1/12 — स्नातक निर्वाचन मंडल
- 1/12 — शिक्षक निर्वाचन मंडल
- 1/3 — विधानसभा सदस्य
- 1/6 — राज्यपाल द्वारा नामित
30. विधान परिषद में राज्यपाल का नामांकन
राज्यपाल कुल सदस्यों के लगभग 1/6 को नामित करता है।
नामांकित व्यक्ति साहित्य, विज्ञान, कला, सहकारिता आंदोलन और समाज सेवा में विशेष ज्ञान या व्यावहारिक अनुभव रखने वाले होने चाहिए।
31. क्या विधान परिषद स्थायी सदन है?
हाँ।
विधान परिषद Permanent House है।
इसे विधानसभा की तरह भंग नहीं किया जाता।
32. सदस्यों का कार्यकाल
प्रत्येक सदस्य 6 वर्ष के लिए चुना जाता है।
हर 2 वर्ष में लगभग 1/3 सदस्य सेवानिवृत्त होते हैं।

33. विधान परिषद के सभापति
विधान परिषद अपने सदस्यों में से सभापति (Chairman) और उपसभापति (Deputy Chairman) चुनती है।

35. सबसे महत्वपूर्ण
राज्य मंत्रिपरिषद केवल विधानसभा के प्रति सामूहिक रूप से उत्तरदायी होती है।
विधान परिषद के प्रति सामूहिक उत्तरदायित्व नहीं।
36. विधेयक क्या है?
कानून बनने के लिए प्रस्तावित विधायी पाठ विधेयक (Bill) कहलाता है।
विधेयक विधानसभा या विधान परिषद में प्रस्तुत हो सकता है, लेकिन Money Bill केवल विधानसभा में।
37. साधारण विधेयक — Ordinary Bill
द्विसदनीय राज्य में किसी भी सदन में प्रस्तुत किया जा सकता है।
38. क्या विधान परिषद साधारण विधेयक को हमेशा रोक सकती है?
❌ नहीं।
विधान परिषद सीमित अवधि तक विधेयक को रोक सकती है।
यदि विधानसभा दोबारा विधेयक पारित कर देती है: परिषद की असहमति अंतिम बाधा नहीं बनती।
39. विधान परिषद की अधिकतम रोक
साधारण विधेयक के मामले में:
- पहली बार — अधिकतम 3 महीने
- दूसरी बार विधानसभा से आने पर — अधिकतम 1 महीना
- कुल: 4 महीने तक देरी कर सकती है।

40. क्या राज्य विधानमंडल में संयुक्त बैठक होती है?
❌ नहीं।
केंद्र में लोकसभा + राज्यसभा के लिए संयुक्त बैठक की व्यवस्था है।
लेकिन राज्य विधानमंडल में विधानसभा + विधान परिषद के बीच deadlock के लिए ऐसी संयुक्त बैठक की संवैधानिक व्यवस्था नहीं है।
राज्य विधानमंडल में भी केंद्र की तरह संयुक्त बैठक होती है।

41. Money Bill
राज्य में धन विधेयक केवल विधानसभा में प्रस्तुत किया जा सकता है।
42. विधान परिषद की भूमिका
यदि राज्य में विधान परिषद है तो: विधानसभा से पारित Money Bill विधान परिषद को भेजा जाता है।
विधान परिषद 14 दिन के भीतर सिफारिशें दे सकती है।
43. क्या विधानसभा परिषद की सिफारिश मानना अनिवार्य है?
❌ नहीं।
विधानसभा परिषद की सिफारिशों को स्वीकार या अस्वीकार कर सकती है।

45. धन विधेयक कौन प्रमाणित करता है?
राज्य में विधानसभा का अध्यक्ष (Speaker) प्रमाणित करता है कि कोई विधेयक Money Bill है या नहीं।
46. क्या विधान परिषद के सभापति को Money Bill certify करने की शक्ति है?
❌ नहीं।
यह विधानसभा अध्यक्ष की शक्ति है।
47. विधानमंडल से पारित विधेयक
विधेयक पारित होने के बाद राज्यपाल के पास जाता है।
अनुच्छेद 200 के अंतर्गत राज्यपाल:
- अनुमति दे सकता है;
- अनुमति रोक सकता है;
- गैर-धन विधेयक को पुनर्विचार के लिए लौटा सकता है;
- राष्ट्रपति के विचार के लिए आरक्षित कर सकता है।
48. धन विधेयक वापस भेजना
राज्यपाल Money Bill को पुनर्विचार के लिए वापस नहीं भेज सकता।
49. राज्य बजट — अनुच्छेद 202
राज्य का वार्षिक वित्तीय विवरण (Annual Financial Statement) विधानमंडल के सामने रखा जाता है।
इसे सामान्य भाषा में राज्य बजट कहा जाता है।
50. बजट कौन प्रस्तुत करता है?
संवैधानिक रूप से राज्यपाल की ओर से बजट विधानमंडल के सामने रखा जाता है।
व्यवहार में वित्त मंत्री इसे प्रस्तुत करता है।
51. Demands for Grants
सरकार के प्रत्येक विभाग के खर्च के लिए अनुदानों की मांग (Demands for Grants) रखी जाती है।
52. अनुदानों की मांग पर मतदान
अनुदानों की मांग पर केवल विधानसभा मतदान करती है।
विधान परिषद मतदान नहीं करती।

60. क्या विधायक सदन में कही हर बात के लिए अदालत में उत्तरदायी होगा?
सामान्यतः: सदन में कही गई बात/मतदान के लिए न्यायालयीय कार्यवाही से संवैधानिक संरक्षण प्राप्त है, लेकिन: सदन के नियम और अन्य संवैधानिक सीमाएँ लागू रहती हैं।

The law-making body of a State is called the State Legislature.
According to the Constitution, the State Legislature consists of Governor + one or two Houses.

3. Two Forms of State Legislature
A State Legislature in India can be Unicameral — only Legislative Assembly.
Or Bicameral — Legislative Assembly + Legislative Council both.
4. How many States currently have a Legislative Council?
Currently, 6 States have a bicameral legislature in India.

5. What does Rajasthan have?

92. Chapter Summary
The State Legislature is the law-making body of the State, consisting of the Governor and one or two Houses. A State can be unicameral (only Assembly) or bicameral (Assembly + Council). Currently, 6 States have a Legislative Council. Rajasthan is unicameral with a 200-member Assembly.
The Legislative Assembly is the directly elected popular House with a 5-year term. The Legislative Council is a permanent House with members serving 6-year terms, with 1/3 retiring every 2 years. The Council has limited powers compared to the Assembly, especially regarding Money Bills and the responsibility of the Council of Ministers.
The Speaker of the Assembly plays a key role in certification of Money Bills and presiding over the House. The Anti-Defection Law (Tenth Schedule, 52nd Amendment, 1985) applies to State Legislatures as well.
Rajasthan's first Assembly was formed in 1952. The Assembly is located in Jaipur. The minimum age for Assembly membership is 25 years, and the maximum gap between sessions is 6 months.
